Khai k ho k..nepal aako stamping garna..2 hafta agadi mero saathi le 221g payo aile maile..uscis ma pathaunu parcha review ko lagi bhanche k garne garne..aaafno kaam 2 hafta ma suru huncha uta pheri...

221g is a pain in the A**....I have no idea why it take such a long time and it hurts when you're going to nepal for 1 month long vacation. There's no specific time on how long 221g takes. It might take 2 weeks, 2 months or 1 year.

Some people get H1b stamping without any problem but for some people it takes forever. I have no idea why is it so.

Could you guys update us on what kind of jobs were u doing in US ? Direct hire or consultancy etc ?

EVC Model ho..client sanga kaam gareko 1 year bhanda badhi bhai sakyo ra H1 bhayeko pani 8 months bhai sakyo..VO le questions ta khasai sodena..Direct Employee-Employeer relation chaina bhanyo ani USCIS ma revocation ko lagi pathaunchu bhanyo.

I'm still looking for details like how to get the visa for canada and how much would it cost for the whole process and how many days do we have to stay in Canada for stamping. I was hoping if somebody has already done this and can provide us details that would be so much helpful.

I went to the lawyer the other day and she especifically told me to go to the homeland for the first time H1B stamping. After that, if we need to re-stamp we can go to Canada or Mexico. Has anyone gone to Canada for the first time H1B stamping?

thanks uhi nepali and hope it works out.

I'm getting stressed. I have a 3 wks in ktm, direct hire, h1b expiring in nov but just filed for a renewal. Im wondering if the new h 1 b will take time to upload on their database. All posts on sajha regarding the H1b stamp are old. Has anyone had recent success?

Just email embassy at KTM that you will be coming for stamping and ask them to do the PIMS. Be prepared to answer the question in detail.

PIMS is just the transfer of your petition information from USCIS to the consulate. It will help you avoid 221g or further delay.

consktm@state.gov is the email address.

You can do that prior setting up the interview date.

Uscis lai pathauncha bhaneko cha review ko lagi.. na kehi email cha na ta kehi khabar..barbaad jula

 First of all, the sponsored employer has the right to revoke the H-1B sponsored by them by just writing a cancellation letter to INS stating that the alien is no more working with them and thereby cancel the H-1B sponsored by them. USCIS also acknowledges the letter and send a confirmation of cancellation notice of particular alien's H-1B. The employer maintains these cancellation notices under public access folder.They also terminated certified LCA created by them for that H-1B by just going into their DOL account and withdraw the LCA.
The Indian Cosultancies are very famour for this,any time they get such 221g letters stating about the company information and relatioshio with the clinet they file for withdrawal stating that the person is no more working with them and cancel H1B sponsorship.

Hi Stupida, I am sorry; I did not see your question earlier as I had not logged in Sajha for a long time. You probably already know by now documents like 'permission to work in foreign land' is very circumstantial and without even having any documents on hand, one can convince the officials at Tribhuwan airport simple by answering the basic questions. In your case: since you produced related documents earlier, they probably did not question about it. And, if they did, you must have had reasoned your way out of it.

Two of my Indian friends went to Canada last week for Stamping. They were contractors and got visa.

Goto Canada for H1B stamping has both pros and cons:

Location:

Ottawa: better for eastcoast ppl, comparatively cheap
Toronto: better for midwest , not so cheap
Vancouver: westcoast, expensive city
Calgery: beautiful place, far land
Montreal: if you know french language, expensive

Go to any of these location (find out if you have any relatives or friends living there !!!, stayig longer in hotels are expensive. If you do not have anyone in Canada and takes long time to get vis stamped, you end up paying $ 150.00 for reasonable good hotels. think about it....in that case going to Nepal and staying with family and having nepali food is far better in my experience.)

Pros:
1. takes shorter time for approval than Nepal.
2. Can work from hotels to US Remote Desktop, so you can work (Most hotels have high speed WiFi which you can not do in Nepal.)
3. Cheap flights or you can drive on your own. or take bus from DC or NY to toronto.

Cons:
1. If you have to stay longer than a week, you end up spending more $$$
2.Gets frustrated with one one around and have nothing to do.

So, think before making any decision. Can someone pls mention the same for Nepal visit who have gone to Nepal for H1B stamping.

Yes, getting visa for Canada is not a problem. Apply online to Canadian embassy and appear for an Interview to the earest consulate office, not much hassle. Once you are done with the Canada visa, apply to the US embassy for H1B stamping through embassy site online or through some broker site for faster processing and earlier interview date. Regarding PIMS verification, I doubt if sending email to the consulate general even before applying for interview will help. It's even beyound their reach, PIMS verification is not worst than getting 221g.

3. Origional passport

4. H1B photo copy

5. Applicant for tourist visa

6. If you already get an appointment for h1b stamping, provide them with a copy of confirmation.

 Step 2: Once you receive your tourist VISA, now GET an appointment for h1b visa stamping in canada by clicking here (https://www.nvars.com/Production/userhome.aspx ) .

 The fee for using this service is CA$8.55 payable by Visa, MasterCard, American Express credit cards.  Once you have your appointment in hand, now collect the below list of documents and get ready for your travel.

 H1B: Distinguished Merit (Other than Nurse)

 · DS-156 (application form). (http://www.consular.canada.usembassy.gov/form_ds_156.asp )

· Valid Passport (at least 6 months).

· Proof of legal status in Canada: original or certified copy.

· One passport-size photo. (http://www.consular.canada.usembassy.gov/visa_photo.asp)

· Older passports containing previous visas.

· Documents substantiating previous legal status in U.S.

· Non-refundable U.S. Visa Application Fee (http://www.consular.canada.usembassy.gov/visa_fees_canada.asp)

· Original or copy of Notice of Approval Form I-797A or I-797B.

· Current employment letter indicating the nature of work, duration and salary.

· Recent paystub/pay slip.

· Copy of I-129 petition completed by employer and filed with D.H.S. (Your Employer will provide)

· Copy of approved LCA if applicable. (Your employer will provide)

· If previously under J-1 in U.S. applicant needs waiver of 2 year foreign residence rule.

· Evidence of qualifications must original or certified copy. Consular officers in Canada may refuse to issue a visa to H-1B applicants if their education and/or work experience is solely or predominantly from a country other than the U.S. or Canada.

 Step 3: If you are driving or flying, @ Canada Port Of Entry,make sure you state that your purpose of travel is either tourism. Visiting friends or vacation etc

 Step 4: Please carry some kind of documents to show the proof of your visit. Like hotel confirmation or address you are going to stay, or places you are going to visiting.

 Step 5: Don’t go hours and hour earlier to your appointment time and stand outside consulate, in Canada they will only allow you to stand in Q before half hour only.

So please don’t let yourself be in cold weather for long time. You need to be composed when you see visa officer, so make sure to be tidy and active during your appointment.

 Step 6: You usually receive your Visa stamping in a one day, sometimes in 2 business days so be prepared to stay and visit some place around.

 Step 7: While coming back again @ US Port Of Entry you will need to show your newly stamped Visa and answer their questions. Usually about your job profile, how did you get your job, Salary, Offer letters from clients etc.

 Step 8: Happily go home and relax.
