My situation:
Working for civil engineering firm since last October. H1- B started this October. But company is too slow since last three months and do not know how long it goes. I may be laid off soon.
Before lay off, I am going to ask for 2 -3 months of unpaid leave from December and going to Nepal. After coming back, it will be almost Feb last and for March I use two weeks of paid vacation time and get last pay cheque. In the mean time I will get admission in my previous school for Ph.D for Simmer 2010.

Questions:
1.Is there going to be any immigration problem for taking that much long leave?
2. Between April to May last (start of summer class), Do I need to be in H1-B as I will be applying for change of status from H1 to F1?

if you do some research on the topic, you will find that long leave is not a issue. This doesn't mean that you will not be taken aside from the line for questioning. It is upto you to prove that you are still employed by the company when u come back. This can be done by letter of employment. 


For your next question, you will need to be in H1 till you convert or apply for F1 via school.


 


Pls consult the lawyer or the school's internation advisor..
