I was out of status for number of years before TPS. Can my employer sponsor me for a green-card or Status adjustment. If so what category they can file. Thanks

@phish Hi sathi, if you have been out of status for a long duration, there will be some issues.

For Adjustment of Status via green card process, you MUST NOT have been out of status for more than 6 months before you applied for TPS. Unlawful presence for more than 180 days (6 months), triggers a 3 year bar, and unlawful presence over a year triggers a 10 year bar. There may be provision for appeals. See link below.

On November 3, 2016, we accepted the fingerprint fee for your Form I-821, Application for Temporary Protected Status. Our Nebraska Service Center location is working on your case. We mailed you a notice describing how we will process your case. Please follow the instructions in the notice. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

On October 31, 2016, we received your case for i-765, and we are processing it at our Nebraska Service Center location. We mailed you a notice describing how we will process your case. Please follow the instructions in your notice.

Print nepal TPS page and federal register notice. Federal register notice is quite long, so HR will find it hard to go through it and most of them dont know how TPS extension works. So highlight all the important points and how employers should fill i-9 form etc yourself with a highlighter and show them. And if they use E-verify, it will make things easier. Your expired EAD card will pass the E-verify. Ask them if they use E-verify.

Are you sure, you highlighted the main points ? May be you should ask to talk to the HR director if its a big company. Most HR co-coordinators, they don't know a thing.

In the Federal Register Notice, there is somewhere written that "they can't reject expired EAD for TPS when it is extended. They can't discriminate.... ". Show them that part and to run E-verify if they use one. Also there is a ph number somewhere, where HR can call and confirm your EAD. If you were a recently hired or had been working for a while, you can make them accept it. You can even threaten them with a lawsuit. I was a recent hire and had to go through what I said in the previous post (not threatening with lawsuit though ).

If you haven't been hired yet, that's a different story. They can hire at their own discretion. Practically (Technically you can sue them ! ) there is nothing you can do about it.
