Hi everyone,

I have heard , people who are using TPS EAD not need to pay the social security, medicare taxes from their salary because it is just a temporary status and we are not a citizen or green card holder. Please provide me any information you know or links. I really need to have the information ASAP.

Thanks,

You need not to pay social security and medicare tax, but you will have to pay federal and state tax.

Yes that's what I thought but I am not finding online information or proof. Cause I need to give it to my manager. They don't accept verbal info.

https://www.irs.gov/individuals/international-taxpayers/aliens-employed-in-the-u-s-social-security-taxes

"The exemption does not apply to nonimmigrants in F-1, J-1, M-1, or Q-1/Q-2 status who change nonimmigrant status to a status which is not exempt or to a special protected status."

The taxes have to be paid.

This depends on if you are a permanent resident for tax purposes or not.

You can determine your status here.
http://www.form1040nr.com/Residentstatus.php

If you a permanent resident for tax purposes, you have to pay all the taxes as a permanent resident (even though you are not a permanent resident).
