Hello everyone, I have a question regarding TPS. I went to Nepal on July 2015 and came back from Nepal on August 2015. I was here in the US since Aug 2014 to july 2015 and my question is whether I would be able to apply for TPS since I went back to Nepal on july 2015.

If you were here during the earthquake. You are eligible I believe.

@taremam_bhai, You aren't eligible to apply for TPS as you left US after TPS was approved for Nepal (June 24th , i guess). You have to maintain Continious residence in US after the TPS was approved which in your case doesn't apply as you left and visited Nepal in july. Sorry!!

You might still qualify for TPS
Have been continuously residing (CR) in the United States since the date specified for your country. (See your country’s TPS Web page to the left). The law allows an exception to the continuous physical presence and continuous residence requirements for brief, casual and innocent departures from the United States. When you apply or re-register for TPS, you must inform USCIS of all absences from the United States since the CPP and CR dates. USCIS will determine whether the exception applies in your case.
