Hi Friends,

My Company is filing for my green card. I have a three years bachelors from Nepal and Masters degree from US and arround 3 years of work experience in US.
Is the Education and work experience enough to apply GC in EB2. Any experiences please share.

Thanks a lot.

As far as I know, you need 4 years Bacholers and 2 years masters for EB2.  I think your 3 years bacholers from Nepal might be an issue so better consult with a good lawyer.

These days uscis is saying 3 yrs bachelor + 2 yrs masters is not equivalent to us masters. Does not have 18 yrs of education. So could be denied at I-140. But as we all know every thing depends on case by case. If your employer is desi crap be careful.

Mitra haru, sab jana ko comment haru dekhera malie pani kehi kuraa share garna man laagyo, I hope I can share some insight...

1. Job requirement dictates if it is EB2 or Eb3 (example if your company has 14 job title Computer Porgrammer as a bachelors requirement, they cannot apply you as Eb2 candidate.. No matter if you say senior computer manager or lead computer programmer.. in order for lead/senior to be different than a regular computer programmer your job function has to be 50% different than that of a computer programmer which is hard to prove, you are better off selecting a different job title.. Like a computer manager )

2. A US degree prevails everything.. If you 3 yrs of bachelors or 5 .. A uS degree will qualify you to apply as an Eb2 candidate, if the job requires such..

3. SVP, where does it come to play --- If the processing officer decides to $crew you, it plays a big role.. check out flcdatacenter.com.. Most IT and business job has a maximum SVP of 7.. A master degree itself will give you a SVP of 7 or a bachelors degree SVP3 and 4 yrs SVP 4 = SVP7.. If the processing officer has a hard day.. and comes across your application where it says Bachelors + > 4 yrs or Masters + >0 yrs.. He can ask you for business necessity which will send you back to the queue and you will need to wait for 2 yrs before he will take a look at it again.. The best bet is if you have a master degree apply as Master + 0 yrs experience.. That is your safe way to the promise land..

For guys that has bachelors degree abroad...

Although rules are tough for ppl overseas.. Because at any point of time they can say business necessity and push you back in the line asking for a degree evaluation.. Although ppl have applied with bachelors + >4 yrs experience, as I said it depends on what day the processing officer has.. As per the DOL rule they can always ask for more reasoning if they find your application has surpassed their guidelines of SVP.. Totally depends upon them..

As far as the salary and job title are concerned .. Please let me bring into your attention that an employement based Green card is for your future not present, that is why it is recommended that you stay with the company for one year after you get your green card.. Although You must be very close to the Salary range

example - If your salary is 65K and your PWD is 95K .. Your company must show that he has 30K additional in profits that he can pass it on to you.. But if your salary is 90K then its matter of 5K .. remember you are part of his expense so your salary is already accounted when he calculates his profits..

I hope I could share some insight towards what you are looking for

Good Luck

Is there any difference in terms of getting audited of process of filing lobar certification in EB-2 category from University or from company like Desi or others??? Does University sponsored case gets less audited? What historical data shows?

Hey allswell,

I'm also in process of applying GC thru Employment. Did your position required for  Masters degree or Bachelors degree? Did you get it thru EB2 or EB3?

I have masters degree and four yours of bachelors degree. But when my employer advertised for my position, they mentioned minimum requirement as bachelors. However, the job requires the knowledge and skill of masters degree. It is job Zone 5 as categorized by department of labor. when I pointed out to my employer that it can lead to EB3 process, my employer say that as this job practically requires masters degree, they are going to find some ways to file it in EB2 process. But I cannot figure out how they r going to prove that. Does anybody here have any idea?

awayfromhome,
I am not sure about that... but as far as i know.. if you have masters and your employeer is filing GC in EB2.. it can be advertised as Masters and no expriences... You do not need experience... You can further contact your company lawyer.

sojho manche.

While advertising for my PERM .. my application also had Minimum Bachelors Degree + 5 Years experience or Masters Degree. That's the standard way of advertising i guess..

You don't need to have any experience if your your employer advertised your job description which requires master degree. You even can have 0 years of experience.

Also it doesn't matter how your h1b was applied (Bachelor quota or masters quota). Green card is for future employement and it has nothing to do with your past history (how and where you got your h1b or any other visa).

My only worry is if perm with masters + 0 yrs experience will pass thru. I am not sure but there might be plenty of us citizens with similar qualifications and that may push the perm application to go thru audit.

Guys please share your experience.

AwayFromHome,
I have seen lots of people who had got perm approved with Masters+0 Yrs of experience. When your employer filed job description advertisement, their first priority is the US Citizens. Because they couldn't find the US Citizens, they applied labor for you. So If you ask me, Masters+0 yrs of experience works well with no issue. Masters degree itself equivalent to 5 years of experience after bachelor degree.

sathi haru..sabaiko thread pade..ali ali idea paye..aba idea lai ali elaborate garne niskarsama ayeko chu.

i m doing master's in computer science. complete huna 8 mahina jati lagca hola.
beeteko ded barsa deki ma cpt ma full time as a contractor IT sector ma kaam gardai chu.
mero Employer(consultancy) le yes pali(april 2012 MA) mero h1 file gardai ca. painca paidaina..don't know..but i am thinking for green card on eb2 category.
i have 3 years bachelor + 2 years master's both in computer science. as according to the thread it seems like after having 2 years master's i don't need to include my us experience though i have been working since last 1 and half years.

few quick questions.

1. master's ko graduation bhai haatma degree auna lagbhag ajhai 8-10 mahina baaki ca.let's say 8 months
so k ma aile deki nai under eb2 green card file garna sakchu? I mean green card under eb2 can be filed after graduation only or before few months of graduation as it may take a time to process till then i can graduate.

2. i m working as a contractor..and i like it..client may change but i want to work for the same employer(consultancy) They are not desi.
as a contractor rahera nai can i file green card on the basis of eb2 or i have to have a permanent job.

Dhanyabad sabai sathiharuma.
I indeed appreciate it.
