pakistani giving trouble to Nepali

Actually the issue i am going through is, I am a student and I worked in Pakistanis store at Manhattan for like 3 months but he never gave money on time now the problem is that because of his this late payment I left the job. I still need $900 to take from him as my
salary but now he is saying that he don't have money and I cannot give you. He even said, you are illegal and you cannot work and you cannot do anything to me.
Is there anyone who can help me what kind of action can I take him to get my
money back and I being in a same side.
Anyones comment will be much more appreciated.
contact the department of labor. go to the DOL.gov website, there is a form for salary that is left unpaid, someone from the labor department will contact you and the employer.
tell that pakistani that i know i am illegal but if i complain not only i will be in trouble, you'll also have to pay hefty fine, you'll lose your license and face deportation etc etc, for hiring an illegal worker.
It sounds like this paki is used to doing what he has done to you. If you are willing to take the risk of getting into trouble you can contact department of labor because law will apply to both of you. You have to prove that you were unaware of legal bindings when you decided to work for him.
In my view get a Nepali lawyer file a case against him (sue) for non payment, racial profiling and financial damages to around 10k. Once case is filed serve him officially if he wants to settle thats fine if not you can purue the case.
Tell the lawyer once settlment comes in you will go 40 - 60 % . But this will take time but always seek advice from your lawyer or authorized law practitioner..this board can only suggest you
Get some couple of gango guys and threaten him, that bastard will pay you with interest because the asshole might be thinking you won't do any thing.
Realistically speaking, you cannot do much without risknig your own stay in the US. So just forget about your 900 dollars and move on. Learn from your experience is your take home on this one. Never work for noboday unless you get paid in time.
he knew u were student and is not authorized to work - he hired u knowing thus which means he is in trouble too if you file a case. it will be risky but is good way to teach him a lesson and vent your anger.
guys .. but whats gonna be with you... if they know like u were working illegally.. isn't that going to effect u.. i can understand it can teach that bastard a lesson but wont u get urself in trouble??? I m a new person in this place so jsut wanted to know.. !!!! what can be the result if the gov knows u r working illegally.. ????
You can File WH4 Form at DOL but it might land u in trouble as u r not Legally eligible to get the Employement(provided u don't have GC,OPT,CPT,H1b,EAD,Severe Economic hardship)..So the best thing to do is threaten him that u have hired a Lawyer and he is going to report to DOL..Remember that it's not only u but he is also in the Line..He is not supposed to hire Non-Immigrant without work Authorisation and he might loose more money than u and can even Loose his GC and face deportation(if he's not a Citizen)..Play the Threatnening game BRODA..Hope it works for u..
my bf had same problem ........ he when back to owner tell him that if he not gonna pay his money he will tell police that he hair illigal worker for his place and he very little those worker dont pay text ....that wat tell his bose next day he pay all his money ......if there more worker call imagration office tell him that he hiar people less money none text .............

Dude, You don't have to do anything. Go to a lawyer and ask him to write a letter to the Paki, stating he will face a legal action if the wage is not paid in full within 2 weeks. The evil Paki should take this seriously and to avoid facing the court, he should pay you. This worked for me sometime back when i was dealing with an uninsured driver, I used school's free attorney to write a letter. And he responded within a few days.
You don't actually have to sue him. But once the letter goes to him from lawyer, he knows you are serious about your money....Aaaya $900 gaya $60.00.
