Hey all, I need a suggestion.
About 2 months ago, a person hit my vehicle with his own and then he claimed the insurance but was denied. Now he is telling me that he is going to the cops and convict me of drunk driving and claim for the damage charges against me. We were together for 3 hours in the party and now he says that he will convict me by showing the cops with a foto of mine holding a beer. At the time, no cops were called. Can the conviction be possible now. Also now the guy is really harrasing me. He's been a pain in my butt. Can i instead sue him or convict him for harrassment ?

you are totally safe. a person can drink a bottle of beer or one drink and can drive safely after an hour. make sure you tell the cops you had only a bottle of beer before couple hours the accident has happened. the blood alcohol limit is 0.08 at most of the states. 1 bottle beer or 1 drink before an hour makes your limit less than .08 which is totally safe. so to be in safe side tell the cop that you had only one bottle of beer couple hours ago since that guy cannot show picture of yours holding more than one beer.
do not worry, if you are not responsible for the accident you are in a safe side and he will be the one in trouble.

BAC (Blood alcohol content) increases by 0.02 for every bottle of beer and decreases by 0.02 for every hour that has passed since you start drinking.
The legal limit is 0.08. You can drink 3 beers in an hour and still be fine (BAC would be 0.06 in that case), or you can drink 5 beers (0.1 BAC), and wait 2 hours (decreases your BAC to 0.06) before driving!
If you had really left the party with BAC under control then you should be fine.
fortunefaded, you are almost right there...the variation in BAC level is highly depends on person's fat level in individual body. so it is not same in all cases. it is very different in case of female since they have high fat level. so in average a bottle of beer/ or a drink an hour ago is safe limit as per the state rule.

You have not described properly your case here.
1. Had you have drinks before that particular driving episode?
2. Which picture he is talking about? Does he have even a photo of your holding a beer? Or is it that when you had a car hit, you were holding beer can and driving? Not clear , man.. write properly.
3. If the cop was not called in at the time of accident, how the hell he can prove that you were drunk and driving? Bloody hell, don't tell me he will bring a police and test youur BAC now.. after three months..ha ha.
4. He is quite stupid. A quick check with his insurance company will reveal if he did make a claim and if his claim was disallowed. On what basis it was disallowed? and so on. Now since he could not get coverage from his own insurance, he is trying extortion method to cough off some money from you... ha ha.. that's a hell lotta reason for him to get in trouble now.. ha ha..
5. Don't fuq-ing be afraid of his harrassment. Tell him that you are already consulting a lawyer to file a harrassment case against him - for $500,000. That should scare him his brain out. To settle the matter he may even let you sleep with his woman.
I don't think you are totally safe but you don't need to worry too much either. First of all, can that guy prove that the picture was taken the same day accident happened? Holding a bottle of beer does not mean you were drunk. Second, if he knew that you were driving under influence why did not he call the police then? Above all, he came up DUI theory after the insurance company denied the claim.
So, talk to a lawyer and next time this guy calls you ask him to talk with your lawyer. Your insurance company might help you with a lawyer. Talk to the insurance company first. No need to go into details of how many bottles in how many hours and how much body fat. That's the lawyer's job :)
i'm amazed by the microscopic analysis of such a simple matter. case like dui has to be caught on spot in oder to process let alone the trial and what not. Just mention the case happened 2 months ago and police will not even record the case (dui). I'm assuming you're in US not in Nepal.

You should've called the cops or done something man.
Unless you were subject to the breath or blood test after the incident, not even God can prove that you were over the limi in the human court of law. I suggest you pretend that you are scared to death at the threats and have a good laugh at how this wanker makes him/herself look like an absolute iddiot.

If it is just a picture of you holding a beer bottle you are ok,, One cannot just go on convicting anyone with a picture of one holding a beer bottle to be responsible for accidents,,,unless there was some witness or live recording..
Next time he calls you ,,have the conversation recorded and warn him of legal action against harrasment ..

Holding beers with damaged car, just in time of incident? Micheal Phelps hold pots too. Nothing was proved.
Ask him to pay you to fix your car otherwise you will call police. Do you have witness who can speak in favour of you. Tell him you will drag him to small claims court if you do not pay.
If he calls just say him, I was trying to reach you, thank you you call , see you in small court.
