I am thinking to apply for GC through EB2 petition if not get selected in H1B to be applied in April 09. Is there anu problem if I want to apply for H1B in April 2010 while EB2 application is in process.
And how much is the fees to apply for EB2 petition.Thank you for your input.
looks like no body has knowledge about it. please write down your openions.
Employer has to sponser you for that.
It depends on where you go
there are varying rated with dhotis
but i don't think they will go to GC process directly unless u have H1B
these are two seperate process. so u can start EB2 anytime. just maintain ur status.
one of my friend paid 5K to attorney besides other expenses.
you can apply or file for EB2.
but before you can file for EB2 you have to go through
1. labor certification
and currently labor certification is taking more than 5 months to get approved from the date of filing. and i believe it takes roughly 4-5 months to actually prepare document/procedure to file it. so best case scenario "11-12 months" by the time you get to stage II.
2. I-140 and I-485
even if you file concurrently. and everything it would be @ least 6 months before you get your EAD.
hmm... can you be in status for 1.5 years without getting H1B .. may be possible for STEM grads..
but with MS+ 0 yrs exp .. .. it might be hard to get labor approved for EB2 ...
anyway its a contradictory theory.
if you get a sponsor. you can try it. it is worth a shot. who knows you are one of those lucky ones who gets their GC in less than 5 months.
