hai guyz,

my friend was deported for DWI case last summer.............may be i posted this thread before also

that was a voluntary deportation......and he was told that............he could apply to US after three months of deportation

now he wants to re-apply to US.......and what about that DWI case. is that gonna go away..........or he will be arrested in the entry port. actually, he had to go to court for the hearing but he was sent to Nepal before the court schedule.....and nobody went in there...........now if he does't go.........there m ight be a arrest waarrent for him...........so can he apply or he has to make sure of the case before he comes up here

anyone with legal idea will be appreciated..............urgently needed...........plz guys........he is frusted up there..............

DWI in US never goes away...its stamped on his forehead forever if he wants to live in US. it goes away only from driving record after 5 yrs, but never from your criminal record.  Good thing is, this is his first arrest, It is not going to effect on you status or anything. it has no effect on H1-B, Greencard, Citizenship later when you apply for them (if that was his only DWI), and if he gets second DWI arrest...its better him to forget about US. he will get jail time also in that case for sure...now, you can go back nepal, and re-enter as usual. sometimes the embassy back in kathmandu takes a month or somthing to get information from US, FBI about the crime report on your fingerprint before they issue the visa. but in couple of my friends' case, they didn't have any problem.

now, he missed the court date, its a big big issue....I have no idea about it. all i know is, they send you notice couple times i guess, and they issue arrest warrent. its bad specially if you miss court date, or didn't provide a specific reson for doing so. the hope is, if he was deported by DHS, then he can explain to the court what happened, and probably wil be fine.

Man he would of should of stay here and go to a court. You are right there is warrant our there for him for not showing up in the court. He could have done a lot if he stay here and deal with it. When he show up in the court he don't have to mention or the court will ask him about his legal status. You just go there and plead guilty or not guilty, pay a fine, and not drive till he get his license back.

Now since he is in Nepal and what he could or you help him to do is contact the court and explain all the situation and the court might see why he couldn't able to show up in the court. I think it would wise to get papers that show you are going to appear in the court once you get here so if in case immigration officer ask or know about his situation at arrival. Good luck to your friend.

What I have heard, a guy from Pakistan had the same case. He was deported for DWI. He was studying at Southern Louisiana University at Hammond , LA.  During his stay at Pakistan , he sent a letter to the senator of Lousiana seeking to help him finish his degree. The Senator did not reply for a month but when the pakistani contacted him again, The secretary of Senator told him they are working on it .

The pakistani got a mail  back home saying he can apply for visa. Than he came witha new visa and he was given clear on his charges and was not even presented on the court. However he paid a fee of 1000 to the Department of Public safety louisana .

any one who drives while intoxicated is menice to the society...that willy wanker was deported ...thats a good news ....now at least one ass hole is out of the street and lives are safe a bit. ..... my fren was killed by a driver who was under influence... so i dont have any sympathy for these kind of motherf***er .

they should put him in a electric chair.geda jasto.
