How to get my spouse to the US?

I am a DV 2007 Lottery winner and I received my permanent residence (visa stamping on my passport) on January 8, 2007. After my first application for the DV in 2005 but before I got the approval via second letter in November 2006, I got married (in October, 2006) in Nepal. Since the US Embassy in Nepal had issued a bulletin at that time stating that if a spouse's name was not included in the very first application for the DV, they would disqualify the applicant if the spouse was included in subsequent applications and/or visa interview. For that reason I did not mention a change in my marital status. Our marriage was registered with the Nepalese government recently. How do I file for my husband to join me here in the US at the earliest? Will he be elligible for following -to-join benefits? What options do I have that will allow him to come to the US as soon as possible. Your suggestions will be highly appreciated

B MARCH, my brother had same situation. He got DV 07 when in USA. After he got his DV, he went back straight to nepal got married in July 06. He came back filled out 230 part I and II and DSP 122. He left his wife over there in nepal. She was studying over there. He filed here with USCIS to adjust the status. He got his green card on March 07. He file following to join for his wife back in nepal. The following to join process has certain criteria that needs to be followed and it has procedure too. She was interviewed and got visa. They got married after he got his DV and embassy did not stop her. I am not sure what is your situation? Did you adjust status here? Did you apply from Nepal? If u adjusted from here, did you get married before you filed your I-485? If not there is no way you can do follow to join. Follow to join doesnot care about whether you got married before or after you apply the electornic DV. It is just related to if you filed I-485 after you got married. Let me konw if i can help you.

b_march, One of my friend had to go thru what you are upto now. Unfortunately, you can't bring your spouse with an immigrate Visa. But you can bring him as a visiter visa or in student visa and get marry in a court. That's what my friend did. His wife is here with him since 6 years and just recentely she got a green card. When your husband applies for the visa in the embassy, do not let the embassy know that you r living in US.

If you are a permanent resident, then your spouse is stuck back in the country. First thing you can atleast do is file Petition for Alien Relative Form I-130. I know that it is going to take a while for your spouse to be in this country legally.. some people bring their spouses as a student also. Unless the visa number is current, your spouse cannot get to start processing for his green card application and that means, no work authorization and no social security number. There is only one PLUS point for filing the Petition for Alien Relative at this point of time. Like last time, they had specially let people related to LPR have a special Vi Visa in which they could come to the United States and work and renew it until the visa number would get current.. Who knows, there would be this announcement again.. Normally they would allow it to people whose case is already filed with the Service Centers and either pending for decision or already approved and waiting for visa numbers. So I guess that would be best you can do at this point of time. ~Sundari

applying for k-visa is your first option. then your spouse will be able to be in usa and you can start the process by filing I 130 and I 485 at the same time. the process would be faster if your spouse is in usa. go to USCIS website they have every thing in it
