Immigration Suggestion form i824 ???

My friend's i140 has been approved and she is now in TPS Status .She was in f1 previously .she was maintaining f1 and tps for a while but now she doesnot have f1 status .She did not violate any immigration status(f1,f1 tps together,now only tps).Trump is now in office.We all know fate of tps is in danger .Her priority date is not available immedietly for eb3 category. If you know please suggest what happens if she apply i824 with approved i140 and try councel processing when priority date available in Nepal ....Thank you in advance

Mr. B, if she was never out of status, I’m not sure why that would be a concern. I’m in a similar situation, as I’ve never been out of status either. My lawyer mentioned that we should be able to switch to consular processing if needed. The only catch is that we would have to wait for the final action date, which might take a few additional months.

@bhamnepali what is consular processing? I mean I can google it but just wanted to ask here.
If our I 485 is pending because of final action date is not current and tps is not renew this time are we safe?

That's what I was talking form i824 (u can change ur approved i140 to counselor processing I guess )

Let’s hope even if it is terminated, we get at least 12 months like before for orderly transition. Good luck to all including myself.

Akku, consular processing is when you apply for your immigrant visa at the embassy in your home country. If you have not been out of status, you should be fine. A plus to that is if you can show strong family ties. For me, everyone in my family including my spouse’s family are US citizens. I am keeping my fingers crossed. Good luck to you.
