Lawyers representing the Central American and Nepali immigrants said the two parties determined on Tuesday that the Biden administration would not agree to their proposals for a settlement in the years-long court case over the Trump administration's efforts to terminate the TPS programs.

Ahilan Arulanantham, a lawyer representing immigrants in the case, said the failure to reach a compromise means the Biden administration will be defending the Trump administration's decisions to terminate TPS protections for tens of thousands of immigrants.

"The government's position here and its conduct over the last 18 months is deeply inconsistent with the president's promise to protect this community," said Arulanantham, who is also the co-director of the UCLA Center for Immigration Law and Policy. "This community has lived in limbo and fear the last 18 months waiting for the Biden administration to fulfill its promise and protect them."

१६ महिनाको अथक प्रयास पछि टिपिएसको संघीय अदालती मुद्दामा बाईडन सरकार र “मारोर्कास विरुद्ध रामोस” (र “मायोर्कास विरुद्ध भट्टराई”) का वादीहरु बिच चलि रहेको सम्झौताको वार्ता कुनै निष्कर्ष बिना आधिकारिक रुपमा टुँगिएको छ।

याद गर्नु पर्ने एकदमै महत्वपूर्ण कुरा: सम्झौताको वार्ता टुँगिनुको अर्थ टिपिएसको मुद्दा नै सकिएको, या टिपिएस नै अन्त्य भएको चाहिँ होईन। रामोस/भट्टराई मुद्दाका वादीहरुले तुरुन्तै 9th सर्किट कोर्टमा पुरा बेन्चको सुनवाईको लागि अपिल गर्न गई रहेको हुँदा यसले संघीय अदालतमा प्रकृया अझ बाँकी राख्नेछ। जसको मतलब टिपिएस वालाहरुलाई यो देशमा बस्न र काम गर्न अनुमति कायम राख्ने कानुनी लडाईं अहिले नै सकिने वाला छैन। यो अदालती मुद्दा जारी रहुन्जेल स्वत: नविकरण (“अटो रिनुवल”) को सहारामा टिपिएस पनि निरन्तर जारी रहि रहने सम्भावना रहि रहनेछ।

सन् 2018 को ट्रम्प सरकारको टिपिएस अन्त्य गर्ने रेसिस्ट निर्णयलाई उल्टाउनुको साटो 15 हजार भन्दा धेरै नेपाली टिपिएस वालाहरु लगायत जम्मा 3 लाख टिपिएस वालाहरुको स्टेटस जोखिममा पार्ने बाईडन सरकारको हालको निर्णयले हामी सबैलाई अत्यन्तै दु:खित बनाएको छ।

तर हाम्रो लडाईं अझै सकिएको छैन। कानुनी मुद्दा मार्फत न्यायको खोजीको अलावा अधिकारले कँग्रेस र ह्वाईट हाउस मार्फत टिपिएस वालाहरुलाई सुरक्षा दिलाउने अन्य विकल्पहरु खोजी नै रहेको छ। सबै टिपिएस वालाहरुलाई नागरिकताको बाटोमा लगाउने स्थायी समाधानको अभियान, र नेपालको लागि टिपिएस को “रिडेजिग्नेशन” हामीले पहल गरि रहेका केहि विकल्पहरु हुन्।

त्यसैले हाम्रो टिपिएस समुदायका सदस्यहरुलाई नडराउन र नअतालिन हामी आग्रह गर्दछौं। टिपिएसको सुरक्षाको लागि हामी निरन्तर लडि रहेका छौं। हाम्रो आगामी दिनका कदमहरु बारे जानकारी पाउन अर्को हप्ता हाम्रो कानुनी सहकारी संस्था ACLU को वकील संग हुन गई रहेको अनलाईन आम सभा (फेसबुक लाईभ) मा सहभागी हुनु होला। मिति र समय तय भए पछि हामी तपाईंहरुलाई जानकारी दिने नै छौं - अपडेटहरु हेर्दै गर्नुहोला।

TPS UPDATE:

After 16 months of negotiations, settlement talks on the federal TPS lawsuit between the Biden administrations and the plaintiffs in Ramos v Mayorkas (and Bhattarai v Mayorkas) have officially come to an end without any agreement.

IMPORTANT NOTE: This DOES NOT mean that the litigation is over or that TPS is over. The current negotiations have ended, but the legal fight to protect TPS holders’ right to stay and work continues as the plaintiffs of Ramos/Bhattarai will be requesting a rehearing with the full Ninth Circuit court (“en banc”) immediately to continue the fight for TPS justice through the federal courts. As long as the lawsuit continues, we will have a chance to ensure that TPS will continue to be auto-renewed.

We are deeply disappointed by the Biden administration’s decision to put the status of more than 300,000 TPS holders, including 15,000+ Nepalis, at risk, by not acting to undo Trump’s racist terminations from 2018.

However, the fight is still not over yet. In addition to the continued push to find justice through the lawsuit, Adhikaar is exploring other viable options to protect TPS holders through Congress and the White House. This includes our campaign to secure a permanent solution - a pathway to citizenship for all TPS holders, and our push for the redesignation of TPS for Nepal.

In addition to what logbendick said, just want to mention that the negotiations that were held for these lawsuits were pushing for a redesignation which is most probably the reason why it failed. Also, the court will take its time to hear these cases and if court doesn’t reach a conclusion by Nov 30, DHS will have to extend it for another 9 months to accommodate litigation. Not to mention, we still have until Nov 30 to pressure the Biden government for an extension. Fingers crossed
