Hello,

I was wondering if anyone could share your experience while adjusting your status from TPS/F1. I am a full-time student working in my field of study with a TPS EAD. I wanted to maintain my F-1 SEVIS records and assumed taking classes would be enough to maintain my F1 status. I am now preparing my I-485 documents and my attorney is suggesting I cannot consider myself to be in F1 status since I used my TPS EAD. According to my attorney, if USCIS determines that I was not in F-1 at the time of filing this application, they may deny my I-485, even if I was in the US legally as TPS at the time of filing. My attorney thinks listing TPS as my current status should be a safer alternative as I was in F-1 status while my TPS was approved and TPS could be used to establish a continuous lawful presence in the US. But with active SEVIS records, I am worried if not mentioning F1 status will red flag my application. If anyone had similar case as mine, I would highly appreciate it if you could share your experience. And if you did, could you please share what you put down for your current non-immigrant status on the I-485 form?

I don't think my attorney is suggesting that we can hide the SEVIS records as it is accessible to USCIS. He is suggesting we use TPS to prove my continuous lawful residence instead of using F1 records which he thinks could be considered as no longer valid due to my use of TPS EAD. I realize this sounds confusing but if anyone else has gone through AOS with F1 status despite using the TPS EAD, I would highly appreciate it if you could share the experience. Also, did you use F1 or TPS as your current status while applying for I-485?

No matter what you have to go through interview process for GC

There will be no red flag if you are you planning to leave F1-Status , just make sure that you have informed your college that you are switching to TPS status .

For example: When my OPT expired I already got my TPS approved and then I filled for I-485 based on employment and I put my current immigration status as TPS.
If immigration officer ask you what is your current status just tell TPS and before F1 and you are maintaining your status legally since last port of entry.

What status did you decide to put in your I-485? Ani yedi F1 violate vayexa vane TPS EAD use garera, AOS garna gaaro hunxa?
