On TPS - cap exempt H1B denied and what are the options now
Hi,
I graduated 2 years ago on F1 and worked on OPT until last year and I started working on TPS after that. I work for a non-profit company and they filed for cap exempt H1b which got denied today. The lawyer told me they haven't gotten the reason for denial yet and will decide what course of action to take.
So, my question is if I want to go back to F-1? How does this process work or what I need to do? Does anyone has experience with this? I am just collecting information before I talk to my lawyer. Thanks
Umm...as far as I know, you cannot go back to F-1 from TPS. You probably would have to go back home and change the status.

another option would be J1 if you are working for the research institution. If your job is research related, you might be able to get 'Research Scholar' status on J1 for 2.5 years and can be reapplied one more time later for same duration (like they said H1b is for 3+3 years total).
