Do any of you have any information available related to divorce laws in Nepal? What are the laws in Nepal? For example, property laws (who gets what after divorce & what percent), childcare custody, spousal support, alimony etc. In USA, divorce laws can rip a man apart so I am trying to compare divorce laws in USA and Nepal to better understand the scenario before I get married. Thank you.
You just give half of the property you inherit from your parents. I do not think there is child support in nepal.
Nepal’s divorce law is really [Disallowed String for - banned word]ed up, and I thin one of the reason Nepalese’s society is struggling is these [Disallowed String for - banned word]ed up laws. On top no body blames them but judicial system is way too corrupt then what is looks at front. They takes freaking two decade to decide on property dispute. People die waiting for court decisions.
During divorce woman can not only claim 50 on property you have after getting married but also claim right on all properties you have before marriage and also on property of your parents . How much more ridiculous it can be? It totally screwed up in the name of woman right.
Not sure about child support and anamoly kind of thing , I think they usually do one time thing there. But I am sure they consider cost raising kids during that calculation.
Don’t even think about getting married, if there is chance of divorce and you have some sizeable properties in Nepal
That's scary situation. I thought divorce laws are more lenient to man in Nepal than in USA. What if your parents haven't transferred their property to you legally though you live in your parent's house? Can she claim on parent's property which is not yet transferred legally?
Yup. Your parents property will eventually be your rights. So she can claim those as well. I have seen this happened. But since most of the cases takes ages, people usually settle it outside the court in cash and drop the dispute in court. And as long as there is dispute , you can not sell that land/home. So if not settled, you can not perform any kind of transaction on that property and get stuck there for a long time.
But if you already had inherited the property ( ansa-banda was done) and your parents have property in their name, that will be safe. Because you already got your share from your parents. However , she can still file a claim and get you stuck their forever.
