You seem to be the same lady that the dude is getting help from. Did you read his explanation?
These douchebags have plenty of time and no brains. Yeah explanation looks genuine, he cannot have traditional marriage now but opt is expiring soon. That's what it seems like. If you don't know for sure that he is taking it, you cannot judge anyone. Get a life.
8848,
why you calling me smart asses. he asked if immigration find out and call it fraud , whats going to happen. i said they will deport you. do you have any other answer.
Hello all,
This guy wanted a suggestion, not a judgement. Both User n Dhoti are losers, (nothing wrong with a guy trying to get a card and live better life), so no point of answering. Afanta you are correct but the whole point of asking help is not to get deported and get a GC. Goodluck Mr. Anonymous, I have no clue how this works. I was here just for comments since some smart folks think they are better than all of us.
8848,
i do understand his question. but he do not want to take a risk and want opinion from people, if it is safe or not. Its like dont ask anyone how deep is the river and try to cross it. Coz people want some one to blame. If he is ready to take risk, go and do it. it is up to the risk taker.. As far as greencard, if you think you can take a risk go and do it. play the game right you might get it...do not make your story public in the forum, where anyone one can judge you.
When you ask question in public forum , especially like sajha where admin do not enforce anything , you will definitely be trolled. I am pretty sure OP was aware of it. Regarding the real question, upon marriage with citizen, you can file the paperwork and if immigration officers are convinced it is real, then you will be awarded with permanent residency with conditions that can be removed after two years. But regarding you and your wife staying separate, it will be hard to convince the officers. I do not think any reason justifies it. If there are circumstances that do not let you two live together, then you two are not ready for marriage. It just turns out to be only for immigration purpose. In that case , your wife can be penalized as well . And you will be in deep sht for sure. So, either try to maintain your status other way like H1b untill you two are ready OR start living together and settle down for good. About your last question, if they declare it fraud, they have right to cancel your f1.

The only document they care is your marriage certificate from the court. They will not come to check where your actual residence is as long as you and your wife have the same address.
Marriage certificate is the last thing they care about, that's just a requirement and they know getting marriage certificate is no big deal. What they care is marital relationship which requires lots of proofs like joint banking, insurance, living together n more. Husband and wife could be separately asked personal questions about each other or about the apartment/room they live in or about an event. If the answers don't match to each other, then denial is highly likely.
I didn't get what the concern here. If you are truly married then what's the worry. People who are married some time live separately for some genuine reason . Just tell them what the reason is.
Even if they deny it saying its fake marriage , you can easily fight it in court. When your wife personally testify in front of judge saying she is married to you and living separately for the period of time for this reason, they can't proof its fake. You will eventually get it.
If it's really a fake shortcut , then you should be worried , and also shouldn't get green-card. And if immigration officer will deny your application and might initiate deportation. Against which you will have no tool to fight with.
