I am not sure I completely understand your question, but assuming you are a F1 student, here is my answer: Have you filed tax returns for 5 years? Health care requirement only applies to "resident alien" international students (you become a resident alien after 5 years; before that, you are a non-resident alien). Non-resident aliens don't need to pay fines for not having qualifying healthcare. If a non-resident alien (who is supposed to file 1040NR) files 1040 (used by resident aliens and citizens), it may cause problems when/if he has to file an adjustment of status (eg. file for Green Card). When you apply for a GC through employment, you may have to submit copies of old tax returns. As a non-resident alien (F1 student for less than 5 years), you need to file 1040NR and 8843 every year.
