H1b approval copy and DL renew
I have a question about H1b copy. I got my h1b approved on OCT 2013.I asked my employer about h1b copy but he asked me to sign a contract. As of my understanding, there is no valid bond labor contract. I told employer that I need to renew my Driver licence therefore I need a copy of my H1b. Employer told me that he will not give copy of h1b unless I sign contract. I couldn't believe that my employer will do this for me. Can you guys suggest what should I do ? is there a legal right to get a copy of h1b from employer ? has anyone been in my situation ? please do give me suggestion because I need to renew my DL soon.
Thanks
What does the contract say? If it is says you have to work for the employer for certain years, then you can sign it because it is illegal and the employer will not be able be use it in the court of law anyway. Since it is illegal, it is therefore not a "contract." He can continue to think it is a contract but in the eye of the law, it will be nothing more than a piece of paper. You're safe.
Yup you can sign for now and get the h1b copy for DL renewal, they cannot use the contract to force you work for given number of years or to underpay u. So sign for now n threaten to sue them in case they use the signed contract to force u later on. Even indian diplomat got stripsearched n arrested for underpaying per separate contract which is illegal in US eyes.
thank you jai_nepal and ark for your valuable information. I appreciate that.
