If you are a overstayed TPS holder who entered the United States legally through "inspection and admission", have no serious criminal convictions, and are Class-Member of an ongoing TPS-related class action lawsuit, you are likely eligible for a bond hearing. You also have strong personal and legal factors that support your release from immigration detention.

However, if you are a TPS holder who entered without inspection (EWI), you may not be eligible for bond, BIA (Board of Immigration Appeals) already decided this case. TPS holders from Venezuela are often easy targets for enforcement due to their EWI record.
