Tax file for spouse

 Hi Guys, How to file tax if wife is US citizen and husband (neither permanent resident nor US citizen) is in Nepal? I found several options but I don't know which one is suitable. I'm expecting  nice option to get max refund from tax expert in sajha. Thanks.

 rampure: if spouse is in nepal and doesn't have SSN, then she should file as single. tax law does not allow you to claim your spouse if they have not been in the states for significant amount of time(for at least 6 months). but if the spouse have been in the states before and has SSN, she can file as married filing jointly. she shouldn't have any problems with it. if you need help, reply in this thread.

 it's not necessary to have SSN to file tax jointly, you can apply for ITIN (individual tax identification number) but spouse should be in the states at least 6 months.

ya, the spouse should fufliff the residency requirment . If he is not here and not been living here , then she will be considered single (just for the tax purposes)

 Thanks all frens for suggestion. Finally I filed married but separate with suggestion from an american tax expert. So, if any body has same problem, this will be the great solution both economically and legally.

If you are married on the last day of the tax year , you are married. If you are married but not lived together for the last 6 month of the tax year , you can file either married filed separately or single. If you have not lived with your spouse for the last six month, just file single. Ask your tax expert , how he or she is going to get the information that needed to file married filing separately? 1) Spouse date of birth , importantly this one. 2) Social security or ITIN  number. Without social security number or the ITIN number the tax software may keep flagging and would not let you complete e-filing. That case you have to file paper, still on that paper filing you need the name and social or ITIN number. Still you have to furnish social or ITIN number.  You can check IRS calling.
