u need a approved LCA to file for an H1B. A LCA usually takes less than a business week to get approved. u don;t need to file for i-539 when u file for h1b. When u file for h1b u file i129 once it gets approved that means your immigration status in under that h1b filed which u got by filing I129. Just my advie, I am not an attorney.
