Hello All my Sajha Frens, One of my fren is in a big trouble, His Long story short goes like this: - Came to US in 2004 Summer on F1 - 2006 Out of status, 2006 fall apply re-instead from other college - Study during that period, and Reinstead denied end of 2006 and stoped going to college. - Moved to another state and got real married with white girl. - Status checked before file green card and it was clear "As lawyer said" - Applied for Green card and gave fingerprint and got work permit. - Interview on end of feb/2012. Now when he checked with his lawyer today, Lawyer said, he had court deportation letter on his record. but lawyer said him to appear on interview after 2 weeks. His questoins are: 1) How was he able to get work permit and interview date if he already had deportation status? 2) What will happen to him if he appear in interview on that day? 3) What will be consequences after he appears in court? Thanks for your input....... KJ

Hey bud why don't you go to the uscis website and spend some time reading...that's a lot better than this. As far as I know if a illegal person is filing AOS he has to go out of th country and apply his fiance visa in a consulate..hope this gives some idea

Things are not clear here. Do you know the date of deportation letter and the reson of deportation? Is the date of deportation before they got married or after? before he filed for green card or after? Once you are married to an American citizen and the green card application is approved, you can not be deported unless for some criminal reason or you are missing some document asked or missed appointment. Because missing documents and dates can result the denial of green card application. Now, he has to prove that the marriage is not fake. May be the lawer missed some procedure or documets that resulted denial of green card (I had one of my friend left US because of lawer). There are lots of information online or USCIS website. I would suggeest people to avoid lawer.
