Hello Friends... I need one suggestion from you.wish you can help me out. I am on H1B since almost 3 and half years. My wife wanna visit to Nepal for a month. She is on H4. She came here on F1 and changed her status F1 to H4 recently also she  never went back to Nepal since she came here. My question would be , what kind of documen should I send with her while applying Visa on Embassy at KTM and how tough it will be to get visa for H4 candidate. Any answers would be greatly appreicated. Thanks Jhilke

I would say it will be just like her applying h4 for the first time. She will need your h1 approval, proof of marriage and her i20s to prove that she was on status. I don't have experience from f1 to h4 but when my wife came those were the documents along with my bank balance. If you have a legitimate job and she was never out of status here, it shouldn't be a problem at all.

@anon what do you mean by out of status?

if you are on H1B  and  trying to travel back to Nepal, I heard there are some cases pending in American Embassy in Nepal. When some h1b holders went back to Nepal, they were investigated on the on company who filed their H1B to see if they were blacklisted.  So, some company might suggest  to travel to Canada and get  passport stamped if you are on H1. It might be the same for H4 but I am not too sure, you might have to talk to some immigration lawyers just to make sure, she will not get stuck in Nepal like others on H1B.   Last edited: 27-Aug-12 08:52 AM
