Hi sajha members, I am curently on my OPT (the one after Associate's not Bachelor's-just to make things clear) and am working legally.By date, i have until mid december of 2011 for my OPT completion. i have already plans to tranfer into a university by Fall 2011. From what i know, as soon as i go back to school my OPT reverts back to F1 and obviously i won't be bale to work legally. But if my employer is willing to help out, what are my options to retain my work auhtorization and continue working legally be it minimal hours? any suggestions and ideas is greatly appreciated.

One of the option is if your Program requires an Internship (if its a graduation requirement and you'll be accounted for the credit) then you may get CPT (Curricular Practical Training) and you can work part time (20hrs) for upto 1 year. But if you go more than 1 year, you'll not be eligible for OPT (after ur bachelors). You should not work more than 12 months on part time CPT if you want to get your OPT after graduation. Other option would be to apply for Employment Authorization based on Economic Hardship, the problem is since you're transfering to University you might have to wait 9 months to apply EAD based on Economic Hardship. First of thank you, purana kagaz, I guess i can rule out CPT, coz i am not interning. As far as economic hardship goes, it would be pretty idiotic to show all that wealth (although fake) to get admitted and then turn around and ask for economic hardship..probbaly why the 9 month wait....but i will look into it..and if so, it would be po...intless anyway. Going off topic, would you say- when applying to a new school, is it a good choice to sponsor yourself, showing your personal saving if one can do so?? or is it better to just go with the standard fake Nepali bank statement?

Its absolutely fine to show your bank balance for the School and it will not affect your Immigration status or anything related to Immigration. It is actually better to show your own Bank Balance from US rather than bringing a fake one from Nepal. I was in the same boat couple year ago and my Int'l advisor preferred my Own bank balance. Thanks, but won't they question how i have all the required funds?? Did they ask you for your W2s and stuff like that...coz these are documents that i wont be able to provide if asked for..
