NewsFlash! ICE Raid at Tri-Valley University Impacts Many Posted 21.Jan.2011 On January 20, 2011 the Murthy Law Firm received numerous phone calls from students registered at Tri-Valley University in Pleasanton, California. The school was raided by Immigration and Customs Enforcement (ICE) on January 20th. There are allegations of fraud by the school's owner. The students are justifiably scared, due to reports of ICE enforcement against the students themselves, as well as the uncertainty of their status and options. Detentions We have received verification that ICE has detained some of the students and placed them in removal proceedings. Students in this situation need to immediately obtain qualified legal representation. They should not make any decisions without legal advice. In anticipation of this possibility, it is best to at least have contact information for removal attorneys working in one's area. It is also a good idea to have funds available to cover a possible bond and legal costs. Options: Find New School Students of Tri-Valley need to quickly find other options, if they wish to attempt to remain in the United States. For some, there may be an option to enroll in a new school. While we are receiving reports of difficulties faced by schools in securing the transfer of the SEVIS record, ICE has issued guidance on this topic: http://www.ice.gov/doclib/sevi... (PDF 73.4KB) This indicates that SEVP can give guidance to the schools in those situations where the transfer out school (Tri-Valley in this case) cannot be contacted or cannot fulfill its obligations to transfer the SEVIS record. Options: Change of Status Some of the F-1 Tri-Valley students may have options to try to change status in the United States. Some are potentially eligible to request a change to H-4 or other dependant statuses. Others might be eligible for H1B status through employers, but may not have enough time to file for the soon-to-be reached FY 2011 H1B cap. Those who have previously held H1B status and do not need cap numbers would not face this problem. Conclusion There are a number of issues that require further clarification in this situation. We are working to obtain additional guidance, and will post any further information on MurthyDotCom. What is clear is that former Tri-Valley students need to act quickly to find alternatives. Attorneys at the Murthy Law Firm are available to advise former Tri-Valley students regarding available options. source: http://murthy.com/nflash/nf_20...

Following is from email Newsletter from one of the Immigration lawyer: Please forward this newsletter to persons you think will be interested.   ICE is sending a chilling message to foreign students enrolled in Tri Valley University On Wednesday, January 19th 2011, dozens of federal agents raided the offices of several administrators at Tri-Valley University in central California. The Tri Valley University, located in Pleasanton, California was shut down. The University offered a variety of degrees including medicine, engineering and law. Susan Su is the founder of Tri Valley University. The raids were conducted as part of a federal criminal probe, according to a spokesperson for U.S. Immigration and Customs Enforcement. The unsuspecting foreign students of Tri Valley who believed they were compliant with the immigration regulations associated with their student status are getting a surprise visit from Immigration and Customs Enforcement (ICE).  These students are then "escorted" to a detention center, placed in deportation proceedings while being detained on bond.   Tri Valley was certified by the USCIS as a university that can enroll foreign students. Immigration officials are alleging that Tri Valley submitted fraudulent documents to obtain certification, specifically documentation demonstrating that Tri Valley is not primarily an online university. However, schools that are principally online or distance learning are not eligible for certification. If schools are not eligible for certification, they become ineligible to issue documentation (I-20) required for foreign students to obtain immigration status as a student. Further, foreign students enrolled in US colleges or universities on an F-1 immigration status are only permitted to take one class or three credit hours online per school session. The rest of the student's classes must be held in a classroom. Therefore, for a student to maintain immigration status, they must show proof they are making reasonable process toward completing coursework and physically attend classes.   A detailed summary and analysis of the Tri Valley case will be forthcoming. Those interested can also follow me on twitter for immediate updates.   TRI VALLEY STUDENTS If you are currently in the process (i.e. filed a change of status) to secure F-1 status pursuant to admission to this University, please withdraw your change of status application immediately. If you are an F-1 admitted to Tri Valley University, please contact our office immediately so that we may advise you of your immigration options.
