TO the attorney and someone gone through same situation out there. I am in dilemma please shade some light. My situation: I came to USA around 2006 and since then i have not gone back to Nepal. During my education ( college days ) i worked outside using my number for more than a year. On top of that I have filed W-2 as well .I did not have other choice. Now I want to  file GC through PERM under EB2. My consultant company is ready to file GC for me. My question is what are the consequences or choices i have to file GC as i was not authorized to work  during my  student period but i did anyway. And i work for more than a year. What are my choices? I hope some of the people might have gone through this process. Please share your experience. Much appreciate Sulab.

No worries, few of my friends have worked for more than two years and I have personally mentored them during application process. There is a section (forgot the form number and category, it's been six years), where they ask if you have worked without permission, just be honest while answering that. I believe you just need to check 'YES'. USCIS generally overlooks such petty incidents unless you did something while working that reflects your moral turpitude.

Hmmm.........couple of my seniors worked 5/6 years like that and still ended up with GC. Idk, I would do what looks right in document.

I spoke with my attorney. He said while filing i-485 AOS (adjustment of status) i cannot file for status of adjustment staying here. i have to go back to nepal and have interview there and that will be the last step of this process and overall process will take around 6-10 month. yeah and i have to say "yes" to that field whatever you guys are referring to if not they will find that during background check or from IRS. It is good idea to accept it and i heard it will be overlooked just have to pay some fine (around 2-5 thousand). Anyone have first hand experience on this please share. Do i have to go back to nepal for final interview? Can't i adjust from here itself? (My attorney says i cannot as i have worked more than 180 days using number ) Honestly I don't want to go back to nepal at this moment. Please share your first hand experience.
