I really think the case should be re-opened. The trial lacked any physical evidences of forced rape which the horny and beautiful Nepalese girl accused him of for 3 times a week for 5 years. I don't know if he had a consensual sex. I want to know if it was a consensual sex. I am pretty much certain that Ajay did not had a forced rape. If it was a consensual sex and she was a minor at that time, he does not deserve 378 years in prison. May be few years behind bars. Guys always make sure that before having a sex with any girl, don't forget to check her STATE ISSUED IDS for Date of Birth. When I used to work in a Deli long time back, I had to check IDs whenever someone purchased alcohol from our store. If possible you could scan the ID and save it in cloud servers incase your hard drive mess up just to be safe. If you don't have scanner, just take that ID and tell her that you would return her tomorrow so that you can scan that ID later on. This is really helpful guys trust me. Never screw a girl if she does not have a state issued ID.

The violations occurred between January 1999 and December 2004. Mr. Dev, a native of the country of Nepal, had immigrated to the Davis area with his parents when he was 13. He is a graduate of Chico State and worked for the California Water Resources Board as an engineer and was active in the Davis Nepali community. In 1999 he and his wife brought the victim, a distant relative of Mr. Dev’s, who at the time was 15 years old, to the United States. She was to live with them and go to school here ostensibly to give her a better education. The victim had been officially adopted by Mr. Dev and his wife in December of 1999 and, according to the victim’s testimony, Mr. Dev began inappropriately touching her within the first couple of weeks of her arrival and later progressed to forced sexual assault and rape on a weekly basis. The assaults continued after the victim turned 18 and was attending Sacramento City College but still lived in the Dev household. The victim moved out of the home in December of 2004, and Mr. Dev continued to try to sexually abuse the victim and even offered to pay her to do so. Mr. Dev threatened to get a gun and shoot himself and the victim if she didn’t allow him to continue to abuse her, which ultimately led to the victim reporting the situation to law enforcement. Detective Mark Hermann of the Davis Police Dept. was assigned the case and while interviewing the victim he had her call the defendant on the phone. During the recorded phone call, the victim engaged him in a conversation about the abusive relationship and whether she should tell her school counselor that he, Mr. Dev, was the cause of her three abortions. What ensued was a conversation where Mr. Dev admitted the abuse and ultimately tried to talk the victim out of reporting it. A search warrant that was served on the Dev home in Davis found child pornography on the computers. This confirmed the victim’s story that Mr. Dev had shown her such pornography prior to some of the assaults. The case against Mr. Dev was not filed until two years later, however, because the victim had returned to Nepal to attend her sister’s wedding and was imprisoned there on charges brought about by a relative of the defendant’s alleging that she had the wrong date of birth on her passport. After court proceedings in Nepal that lasted a year and a half, she was finally issued a new passport and, with help from law enforcement and the U.S. Embassy in Nepal, she was able to return to the United States, at which time charges were filed. While she had been in Nepal, Mr. Dev had traveled to Nepal and phoned her telling her to drop the charges and not to return to the United States. The trial lasted for two months. After the jury deliberated for one week, Mr. Dev was convicted of 76 felony counts including 23 counts of forcible rape; 23 counts of forcible sexual assault; 27 counts of lewd acts with a minor; and 3 counts of attempting to dissuade a witness. The jury hung on three of the counts and returned not guilty verdicts on 13 others. Mr. Dev, who was remanded to custody without bail after having been free on bail for the three years it took to get the case to trial, faces between 72 and 392 years in prison. He was exonerated from the "child pornography" count (i.e found not guilty) for your information. The above press release is from the State for God sake. When I first read that news, I also felt that Ajay was a monster but after careful analysis I believe he is not the monster that the State created.

I am sensing that how it was translated may have convicted him for that long.  Someone arguing that she is not his real father and was 15 when adopted ( even 18 years, lied age for adoption) does not mean he can have consensual sex, period, his relationship with her is father and daughter.  Your argument about her, is horny and having sex with various male does not give the right to Ajaya , to  have sex with his daughter ( a new relation has been established ) and it is similar argument as a 16 years girls is having sex as pro with teens and you 30 years want to have sex with her? You will be convicted for rape charges if she complains and even it was a consensual sex.  Either the girl or Ajaya knows the truth, we are just speculating it. Still I think the jail time is way too much.

newly new bro, I listened to the conversation of two witnesses in that trial who said that the pornography count was acquitted after forensic analysis of the computer. http://www.kdrt.org/node/1900 I don't know exactly at what time in that conversation one of the guy says this count was exonerated. I know its after first half of the conversation. I was listening the whole conversation few moments ago. Please listen to it when you get chance.

I took everything on face value and never questioned the integrity of this article a bit. Few days ago when grgDai bro posted the new thread, I did not care about that thread too. Then after I read a post by kiddo bro and visiting the advocates for Ajay site, I read the accused side of story. I further did some more searches and found out that radio talk. The whole conviction was based on that phone conversation alone. I whole heartedly believe there has been a grave injustice of epic proportion and this case needs to be opened again.  Fabrication vs. The Truth: Porn       The accuser claimed Ajay showed her porn/child porn:   The jury found Ajay not guilty. Computer forensic expert witness testimony revealed the following.         1. The accuser described one video and claimed it was shown to her in early 1999 (while in 9th grade Feb. '99 - June '99) on the defendant's laptop computer.     - The movie wasn't created until 2000, as revealed by the movie producer.     - The defendant's laptop did not exist in 1999. It was purchased brand new in November 2001 (almost 3 years later), confirmed by credit card, purchase and shipping receipts. As well as forensic analysis of the computer.     - The movie was found on the accuser's computer. It was not put there until Aug. 2003 as revealed by the police forensic analysis.         2. The porn/child porn was on the accuser's computer, which was located in her room.     - It was put on the accuser's computer in August 2003 (she was in college and dating). This was only a few months before her adopted parents asked to move out in December 2003 due to the problems they were having with her.     - The forensic evidence proved that both Ajay and Peggy were not at home, but physically at work when someone accessed the porn/child porn on the accuser's computer in her room.     - It was never accessed after the accuser moved out in December 2003.         3. The accuser was 20 years old, in college and dating at the time the porn appears on her computer.     - Trial testimony revealed that the accuser had dated two young men (names withheld) from November 2002 to December 2003.     - One of the young men was seen entering and leaving the Dev home while Ajay and Peggy were at work. The neighbor's testified that the front room curtains would be drawn when the man entered and then be reopened after he left.     - The other young man testified that he was having sexual relations with the accuser at the time she lived in the Dev house.         4. When the forensic evidence came back catching the accuser in a lie, Deputy DA Steve Mount tried to discredit his own police forensic investigation, characterizing it as "so called science".         If someone is telling the truth they do not need to lie. With a bit of research and considering all facts, I too think that justice was not served to Mr. Dev, even though it is beyond any doubt that this man is pretty sick to have sex with with own daughter. For some people in our society, eg. GrgDai as admitted by himself, the fact that she was adopted at age 15 and there was no biological relationship, makes it okay to have sex with her. It is just as sick as if she was his biological daughter in my book. In other words, for all practical matter, adopted = biological. Any reasonable person would not disagree with that.  I also fully believe that Mr. Rapist here is guilty of statutory rape (I have no doubt the sicko here had sex with her before she even turned 16, not sure what California age of consent is...). Mr. Rapist may even be guilty of defrauding the adoption process as his sole motive for adoption might have been to bring her to the US to keep her as a sex toy. In the light of the facts that I learnt since yesterday, Mr. Rapist most likely did not use child porn to corrupt the accuser as alleged. Mr. Rapist most definitly did not forcibly rape this girl 3 times a week as claimed by the prosecution. Since he was found guilty of doing just that, it does not sound like a fair trial to me. In the contrary to my original perception, the accuser seems like a person of extremely degraded values, a pathological lier and one of the most selfish persons I have ever had the opportunity of reading about. As I said before, that still does not suddenly turn Mr. Rapist here into a Saint and like many of you, I would reserve my judgement until I hear/read the transcripts of that "incriminating" phone conversation.

As made clear earlier by other posters, petitions will be signed based on the transcript or audio of the "incriminating" audio tape. So they (Ajaya team) should get that released and publish it first, if they have nothing to hide or nothing to be ashamed of. Any sajha experts on whether this can be obtained under freedom of information act in the state? There is probably evidence on that tape for the prosecution's argument that Ajaya's gang did everything under their control to prevent the girl from returning back to the US... Unfortunately, GrgDai and Antiracist will tantamount to just one signature... And you can puke on this too Obamania...
