This is the most racist thing I heard in the free world.Everyone lies at some point, but lying about race is illegal? Just shows how racist a country Israel is. Arab Man Who Posed as Jew For Sex Will Appeal Rape Sentence Updated: Thursday, 22 Jul 2010, 7:38 AM CDT Published : Thursday, 22 Jul 2010, 7:38 AM CDT (NewsCore) - A married Arab man jailed for rape after posing as a bachelor Jew to dupe a Jewish woman into sex will appeal his sentence, his lawyer said Wednesday. Saber Kashour, 30, was sentenced to 18 months in jail on Monday after he pleaded guilty to a charge of rape by deception, the Haaretz daily reported. The Israeli Palestinian, who is married and has two small children, slept with a Jewish woman he met in downtown Jerusalem more than two years ago, after pretending he was a Jewish bachelor interested in a long-term relationship. When the woman found out he was not a Jew but an Arab, she filed a police complaint that led to him being charged with rape and indecent assault. He later pleaded guilty to a charge of rape by deception as part of a plea deal. "If she hadn't thought the accuser was a Jewish bachelor interested in a serious romantic relationship, she would not have cooperated," Judge Zvi Segal wrote in his verdict. However, Kashour's 18-month sentence was slammed by Kashour's lawyer Adnan Aladdin Wednesday as being too harsh. "Eighteen months in prison is too much," Aladdin told CNN, adding: "We are appealing the very long sentence." Kashour -- who was jailed for two months after being charged then spent two years under house arrest -- said the verdict was racist, Haaretz reported. "For two years I've been under house arrest for nothing," he said. "If I were Jewish they wouldn't have even questioned me. That's not called rape. I didn't rape her in the forest and throw her away naked. She agreed to everything that happened." While Kashour expressed regret for the pain caused to his wife, he denied he did anything wrong. "If I told the woman I was a pilot and later she finds out that I was not a pilot, then she goes and says that 'He raped me'? If I told her that I was a millionaire and it turns out that I am a poor man, then she goes and says that 'He raped me'?" he told CNN. However, the Israeli High Court did set a precedent for the charge of rape by deception in 2008 when it upheld a rape conviction in the case of a man who pretended to be an official in the Housing Ministry. He promised women he could get them an apartment if they slept with him. "It is terrible, but the law says very clearly that if someone has sexual intercourse using deception about his identity to conduct the act, it can be considered rape," said Leah Samael, a lawyer specializing in civil rights and human rights cases. However, the liberal Haaretz daily quoted Elkana Laist of the public defender's office as saying that the Jerusalem District Court had gone too far in its application of that High Court ruling, "opening the door to a rape conviction every time a person lies regarding details of his identity." The argument that obtaining sex by false pretenses is a form of rape has been used in several countries, including the United States, AFP reported. Israel's Arab community numbers 1.3 million, about 20 percent of the population. It includes the descendants of the 160,000 Palestinians who remained in Israel after the 1948 war and establishment of the Jewish state. Relations between the two communities have always been controversial as Israel describes itself as both a Jewish and a democratic state, with rights for all its citizens.

Definitely, it was a racist act, but this Arab guy who had wife and unsatisfied and looking for another women? He should be punished for the all his lie to have sex with that women. He was not fair from the beginning. Somehow he got his rewards.

This is a good case to debate on. On the onset, I’d have labeled the verdict to be racist. However, like in every other legal matter we have to analyze the fundamental law that is being broken. “Obtaining sex by false pretense is a form of rape” argument needs to be analyzed. I won’t consider this to be racism issue no more but merely whether this argument holds or not and my conclusion is that it doesn’t. Rape is a forced act of obtaining sex. Let’s see if we can find a similar example. A guy tells me he can get me a big house for 20K and I trust him and give the money to him. Next day another guy beats me up and robs the 20K I had. Should both of these criminals fall under same category? I guess the difference boils down to white collar crime and blue color crime. In the first instance, I lost money. In the second one I lost money plus I got beaten..there are two crimes done.  Another similarity is a guy using bank card to cheat bank of 1 million dollar and another guy robbing the bank for the same amount. Should both of them get equal punishment? Maybe, maybe not. Now if we say the original argument holds true then series of litigations that insues would be uncontrollable. My friend can accuse her husband of raping her because he lied to her that he would love her till death do them apart.   If you are with me so far, I am hoping I have confused you as much as I have confused myself. I would rule against this being rape because of the last argument I presented, but the potential result cannot be the basis of a law. So I have to build my case again towards the original argument.   Any JD candidates?

Let's say you're wearing a fake GUCCI underwear. Fake Prada sunglasses. Carry some fake dollar bills. So this girl sees all this and gets attracted to you and goes on to have sex with you. But later on she finds that all of what she thougth you had was fake. So according to israeli laws, you could be put in prison for faking it.?

According to Kiddo, he access to sex with all lies. If she had know that would she be have sex with this guy? Hell not, that is the case she is filing against him. You got the point. I was in favor of punishment because he lied from the very beginning to gain sex. The motive was clear. We can not neglect the choice of the girl and even within husband and wife, rape case has been filed and prevailed.

Anything can be turned into anything if you keep twisting the words in the book of law.  It is terrible, but the law says very clearly that if someone has sexual intercourse using deception about his identity to conduct the act, it can be considered rape   Operating words being it can be.  An accident can be turned into vechicular homicide.  there is HUGE difference between consensual and forced $ex.  Intent can be argued. But if seems like the govt is on her side so its a uphill battle

Just because a law says so doesn’t mean you cannot challenge it. That’s what we are doing here. Arizona passed the law recently and federal govt is challenging it. If a law inherently contradicts the pre-existing fundamental laws of right then that law can be ammended.   grgDai and I both gave arguments on why it can lead to an avalanche of other suits. Not sure if I understood what syanjali is saying but go back to my argument. A girl marries a guy because the guy said he is going to take care of her till death. But then somehow she slips and falls and he isn’t there to take care of her, now all the consensual sex they had is considered rape because clearly the guy lied and had he not said that she wouldn’t have slept with him??   Kool, we read the news carefully. Read the paragraph right after the one you quoted, this is where our argument lies.

if its a country where law is fairly practised the guy will get off with no prison time but if law + judge is based on ethical and emotional grounds then the guy willl be sent to the slams. May be the guy one day wanted to get out off the marrriage tell her the truth and marry her?  Who knows?  the news clearly says Arab guy with jew gal so he is already guilty in the eyes of the public.  Why wasnt tiger woods charged with rape because in USA they know there is no grounds for that.....will he same law apply if he were a married jew man no palestini background?  A lot of us like to take the high road but if this case was tried here it wouldnt even make it to the judge...it would be thrown off before that
