I have a small question about third party. I am just trying to get clear understanding of it If Mr.X is Working with Company A and Company A has direct Client XX. is Client B considered as Third party? Or Mr.X>Company A> Company B> Client XX. Now in this case Client XX is considered as third party? How couldn't understand how USCIS defined the third party? I am just trying to know. Please help So which one of above cases Client XX is considered as third party?

In my opinion, if Mr.X is hired by client A and Mr.X is assigned a project in Company B by client A then Client A is a third party.Here, employer is Company B, employee is Mr.X but Client A acts as a mediator or moderator between so considered as 3rd party.

Ok, I would like to repeat and make it clear. If a employer has direct client. then the word 'third party' exist or not?

when you work for a company then your pay check should come from that company. If there is another party who is involved in you pay check then there is a third party involved.

My name is James Carmell. I work for Uneeversal Bainury Systems. This company sponsored my H1B. In fact, this company (in this case my employer) sent me to work at another company called Feadoral Software Inc. Hence, my work station is at Feadoral Software Inc. I fill the timesheet every week at Feadoral Software Inc. and get approval. Then I send this approved timesheet to my employer (Uneeversal Bainury Systems) and I get paid. Please correct me If I am wrong!. I thought company who filed your H1b is your employer. your work place might be different. and third party=end client. Isn't it?

I assume according to the new rule, the one(consultancies) who file for your H1b visa but place you in another company are the third party.
