Unless you are a US resident or a Citizen, the answer is no. You do not qualify for any educational credits!!

As far as I know, it depends on your income. If you are working student, you can claim your tution fee and it is deductible. Try turbotax. It will give you all option.

"unless you are a US resident or a Citizen, the answer is no. You do not qualify for any educational credits!! " If you been living in US for five or more years you are considered US resident for tax purpose so it all depends how long you been here. Student If you are a student temporarily in the United States on an F, J, M or Q visa, and you have been present in the United States during no more than five calendar years, you are an exempt individual. For example, let's say you entered the U. S. on June 4, 2004 as a student on an F visa, and have remained here until 2009. You are a nonresident alien for 2004, 2005, 2006, 2007 and 2008. If you are in the U.S. for at least 183 days in 2009, you will be a resident for tax purposes in 2009. http://www.thetaxguy.com/resid...

yea, Turbotax free edition have limited duductions that it can apply. But if you try Delux, it will allow you all deductible. Try the delux, which you pay $30.00. In my case, I made $25000 in 2008, and was part time student and got my Tution fee $1700.00 back. Family with two kids and part time student, I got about 4800 refund altogether. Hope that helps, Good Luck.

2009 and 2010 Changes For tax years 2009 and 2010, there is a new education credit called the American opportunity tax credit (AOC). This is a modification of the Hope Credit. The maximum amount of the AOC is $2,500 per student. The credit is phased out (gradually reduced) if your modified adjusted gross income (AGI) is between $80,000 and $90,000 ($160,000 and $180,000 if you file a joint return). Exception. For 2009, if you claim a Hope credit for a student who attended a school in a Midwestern disaster area, you can choose to figure the amount of the credit using the previous rules. However, you must use the previous rules in figuring the credit for all students for which you claim the credit. The credit can be claimed for the first four years of post-secondary education. Previously the credit could be claimed for only the first two years of post-secondary education. Generally, 40% of the AOC is now a refundable credit for most taxpayers, which means that you can receive up to $1,000 even if you owe no taxes. The term "qualified tuition and related expenses" has been expanded to include expenditures for "course materials." For this purpose, the term "course materials" means books, supplies, and equipment needed for a course of study whether or not the materials must be purchased from the educational institution as a condition of enrollment or attendance. For more information, see chapter 2 of Publication 970. Income limits for Hope and lifetime learning credit reduction increased. For 2009, the amount of your Hope or lifetime learning credit is phased out (gradually reduced) if your modified adjusted gross income (AGI) is between $50,000 and $60,000 ($100,000 and $120,000 if you file a joint return). You cannot claim a Hope or lifetime learning credit if your modified AGI is $60,000 or more ($120,000 or more if you file a joint return). For more information, see chapters 3 and 4 in Publication 970. Eligibility for the Hope credit. For 2009, you can claim a Hope credit only if at least one eligible student is attending an eligible educational institution in a Midwestern disaster area and you do not claim an American opportunity credit for any other student in the same year.

I don't think there is anything as TAX REFUND for tuition fees but there are 2 things that you can do with your tuition fee you paid, provided you've been in the states for 5 years or are somehow resident. 1. You can deduct a maximum of $4000 under "Tuition and fees deduction. Line 34 in form 1040". This reduces you Adjusted Gross Income (AGI), which in turn reduces the tax you need to pay. In some cases this may reduce your AGI to $0 which means you need not pay any taxes and will get full refund of any federal withholdings. Note: To use this deduction u have to fill out a second form 8917. 2. Instead of deducting it, you can use it as "EDUCATION CREDIT, Line 49" as either HOPE CREDIT (if you an undergrad in the year 1 or 2 in your studies) or LIFETIME LEARNING CREDIT (if you are a graduate student or undergrad student in 3rd year and beyond). You can use upto 20% of the fees you paid as credit (40% for students in Midwestern Disaster Areas). This reduces the actual taxes that you pay. U will need to fill out form 8863 for this credit. Basically the difference is, if you deduct it, you AGI lowers so so does your tax. If you claim it as a credit, you AGI stays the same, the tax is a little higher but then it reduces the tax substantially. I used turbotax free edition and used it as a credit which got me all my witholdings back. Had I used $4000 as a deduction, I would not have gotten full refund. So check both options out. Astu..
