mero room mate usa aye dekhi ( 4 years ) ahile samma tax file gareko rahenacha. Ke usle aba aile samma gareko kaamko tax ekai choti file garna milcha? Thanx for the answers.

There is a statute of limitation of 3 years. Your friend can file his tax returns now, but if he owes IRS the money then he will end up paying a lot of interest and penalty. On the other hand if he is eligible for a refund then he will get his money back. Go to Nepthug but NEVER go to H n R Block....those blood suckers will charge you a lot of fee for something you can do online for free.

Simply tell ur fren to file taxes of all years using separate corresponding year form for each year. Don't file online unless he is resident of US. He has 3 years from the deadline to apply for tax return. Say he has not filed taxed for 2006, 2007, 2008 and 2009. The deadline to file taxes of 2006 is April 15, 2007. He has 3 years from that deadline to apply for 2006 tax return; so the latest date he can apply is April 15, 2010. So your fren has pretty much time to apply. Now if those 4 years u talking about are 2005 - 2008, then last possible date apply for 2005 return is April 15, 2009. Thus his refunds if applicable are cancelled. However he needs to apply tax return. If he has refunds for 2005, he will not get it but if he owes IRS for that year, he needs to pay. One has 3 years to collect tax refund and 10 years to pay tax. 2005 lies out of 3 years tax refund region but lies in 10 years tax payment region.

Jhyamma is right in that statue of limitation of 3 years is not applicable in cases where a Tax Payer did not file a tax return when he should have. Nobody can file tax return online after the due date, October 15 (with extension). Online return can be processed only for tax year 2009 now.
