Hi guys, Does any guy have knowledge about WCA (worker compensation act)? I recently got injured and hospitalized. Even accident was earlier and had got infection right now, went to hospital and told the doctor of case scenario. Doctor hands me "no work" letter and referred through OSHA (labor) hospital for further treatment/recovery. This docm.s go along the route of worker compensation act. But, I had not gone at the time of incident, been couple of weeks before. I am confused how to go ahead, have work restriction and doctors refer to the labor department. Do any have such experience? Just want to know how to deal with company, and thinking company will take wrong way, is it bad/common? Just look for previous incident if you have, I will be grateful.

You should have informed your employer about the accident right away. Comp laws vary from state to state, but in most cases, your company's worker's comp carrier is responsible for paying all of your medical expenses, providing a salary for the time that you can not work, and possibly, compensation for any permanent bodily damages you may have incurred. But since you did not inform your employer right after the accident, you must now prove that the incident did happen at your place of employment and not some place else. You should talk to a worker's comp lawyer as soon as possible. Look in the yellow pages. Initial consultations for worker's comp cases are usually free. Worker's comp issues can be quite messy and having a lawyer on your side is highly recommended. And don't feel bad about the company taking it the wrong way. On the job injuries happen all the time and this is precisely why companies are required to have worker's comp plans.

It all depends what the Dr wrote on his note at the time of your hopitalization. Now if you told them that you were hurt at work, your employer cannot deny that. And getting a lawyer is highly recomended as stated by TRX501, cause the laws vary from state to state. Insurances do not like paying people if they don't have to. Esp if there are permanent damages, loss of function etc usually involes a lotta $$$$. It sure would be helpful to get a lawyer esp when you are negotiating your dissability payment(if you don't have a lawyer insurances normally will give you the least amount of $$ if possible). You shoyuld also get the name of the ins company their mailing address, your claim number, your adjuster's name and phone number, your nurse case manager name and phone number too(your your own convenience). Thank you dears, My emergency unit doctor refers to OSHA, and had called them about the incident. I want hospitalized in the incident, have pain/ reaction in the weekend and gone after that. I let them know everything and just go treatment through my insurance. Even doctor didn’t told me what was happened, he just repeated there he didn’t see any crack or injury but let me to follow OSHA as soon as I can. I had called OSHA people they got every informed and I am not medicated yet, just doctor gave me work restriction letter. Do you think I have to go the lawyer? I think its a minor incident and happened in field job. I am confused what to do or not? I am alone in this city, none of Nepalese community are professional job holder here, who can collect information. Its again meandering me than my pain. again, see you your help
