In one thread, we condemn - Nepali girl student invovled in sex trade in Australia.. and we say that is sad, they defamed our country.. Again, we create another thread of ' Never seen before Nepali Beauty' and post innocent nepali girls picture and starts making abusive comments... treating as if these girls were in bad profession... this thread is one of most viewed in sajha. I am confused!

"Hey ans bro, tyo photo ta hamile tyo keti haru ko ghar bata chorera lyako hoina ni ta. tyo photo tai keti haru le website ma upload gareko thiyo ani hamile tyo photo sajha ma copy garyo. now if those girls dont have any problem uploading their pics in social networking sites and modelling sites, then why should we have problem posting the same shit in sajha? if you have problem, go tell those girls to stop uploading their pics in social networking sites." I beg to differ. Yes they uploaded the pic, but NOT for the WORLD to see. There is a term called 'Online Privacy'. it seems to be relatively new (almost non-existent) around here. Lemme give you an example iamunknown. Just by your nick, you are unknown, and sure enough we in sajha don't know who you are. But what happens if someone you personally know has a grudge against you and spills your name out on sajha for everyone to see? ESPECIALLY if you've been involved in shady threads thinking your anonymity will save you. What then? are you NOT responsible for what you type? Sometimes you just wanna be wild without the whole gaddamn world knowing about it! Sure lots of girls wanna get banged by men with huge phalluses. Do you see them doing it publicly? HELLO NO!. maybe in the privacy of their own secret worlds. AND YOU ARE JUST A PEEPING TOM. Respect others privacy as you would respect yours.
dekchidriver · Mar 27, 2009 10:38 AM
right said dekchi bro!!! we differed while dcnepal violated privacy.. and now if we create these kinda threads...and humiliate our women..thass not quite right!!! u find it...like it..wanna keep it...or masturbate with it..its all good.. just dont bring it up here..and put it in a public forum..only to defame these innocent women...just like dekchi bro said...Respect others privacy as you would respect yours. peace!!!

Firstly, regarding the thread I created, I had lied about some of the pictures being taken from FACEBOOK. None of the pictures that I posted in that threads were from FACEBOOK or any other social networking sites. Almost all of them were public celebrities - models / actresses / porn stars. I would however have to admit that I am responsible for setting a precedence that might have encouraged others to use the images out of social networking sites. But again, they could have used those images legitimately. I won't speak for them. "Yes they uploaded the pic, but NOT for the WORLD to see. There is a term called 'Online Privacy'." Dekchidriver bro, I don't know where did you get that logic from ? If they upload their pictures in the internet, the whole world will see if one can access them unless they make that page a password protected. The extent of their privacy is only a google search away. A simple google search will reveal any images posted online if they are out in the open. Now if someone post their pictures in Hi5 or FACEBOOK, they are stupid to think that their privacy is preserved. Most of the time they reveal much more in their own page about themselves and in some cases (FACEBOOK) ignorantly and voluntarily surrenders their privacy to the Corporations. From Hi5 "Once you register with hi5 and sign in to our Services, you are not anonymous to us. If you are browsing the Sites without registering with hi5, you are anonymous to us," Bro "Online Privacy" relates to company not selling your Personal information to other companies or disclosing to the government. It does not mean that once you post your images you have an Online Privacy i.e "NOT for the WORLD to see" . Hi5, upto some extent, safeguards your personal information by the following statement. "hi5 does not rent, sell, or share personal information about you with other people or nonaffiliated companies " But Read FACEBOOK's TOS, it's more draconian. "By posting User Content to any part of the Site, you automatically grant, and you represent and warrant that you have the right to grant, to the Company an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide license (with the right to sublicense) to use, copy, publicly perform, publicly display, reformat, translate, excerpt (in whole or in part) and distribute such User Content for any purpose on or in connection with the Site or the promotion thereof, to prepare derivative works of, or incorporate into other works, such User Content, and to grant and authorize sublicenses of the foregoing." “[W]e cannot and do not guarantee that User Content you post on the Site will not be viewed by unauthorized persons. We are not responsible for circumvention of any privacy settings or security measures contained on the Site… …Please keep in mind that if you disclose personal information in your profile or when posting comments, messages, photos, videos, Marketplace listings or other items , this information may become publicly available.†So there you go your Online Privacy Issue. I request all those who have FACEBOOK and Hi5 to use their proper judgment while creating an account. My deep research has led me to the fact that FACEBOOK is CIA's global datamining operation. catch me if you can bro, regarding DC Nepal, they have never violated the privacy of anybody. It is legal to take a picture or video of any people on public places like park, road without their consent. It is also legal to post their images and videos online. The only complain I had was they were trying to portray those innocent intimate moments of the couples as social disease and sensationalizing it as a news.

Nas bro, Since you seem to be taking words a bit too literally here's my rebuttal at your s :) don't mind : "The extent of their privacy is only a google search away". Not really. Files stored on servers (mostly running linux) have access permissions to read, write and execute. Whether it be facebook, hi5, orkut or whichever site. Deep down inside the files that are stored on the server have specific rules for who can access them. Just because you upload a file on the 'internet' does NOT mean that the remaining 6 billion people can freely access it. AND IT DEFINITELY DOES NOT MEAN THAT YOU UPLOADED THT FILE TO SHARE IT WITH THE WHOLE WIDE WORLD. Take flickr for example. They let you choose who you want to show your pictures to: friends, family, friends AND family, or TO THE WHOLE WIDE WORLD. And even when you have the option to show to the WHOLE WIDE WORLD, even then you have licensing attributes. Google spiderbots dont go where they are not allowed. You can script your .htaccess file to keep these buggers out so that google wont even be aware that some file exists. Google != omnipotent. Since at the time of your pictures your claim was that these pictures were from hi5,fb it was a matter of concern because of people like you, I wont be able to see how my girl friend spent her week in Hawaii. But you've corrected yourself and told us that the whole hi5,fb was a lie (why would you wanna lie abt something like this?) I guess its not much of an issue if these beautiful women wanted to be admired by the WHOLE WIDE WORLD OF SAJHA. Lastly, just because FB owns the pictures uploaded to it, does not by any length give YOU the authority to distribute what is theirs, unless you are related to Mark Zuckerburg. My bottom line sir, is that please respect these beautiful people and dont do anything that they wouldn't want you to do :D Thats all. Have a great weekend.

I don't think ANS was questioning the legality of the issue, but the morality of the issue. I think he's talking about the unethical nature and double standards of some sajha posters in the way they view and discuss women.
ar es · Mar 27, 2009 2:38 PM
dekchidriver bro, you are totally right on the technicality of the access permissions. If you read carefully, I specifically wrote " If they upload their pictures in the internet, the whole world will see if one can access them unless they make that page a password protected." . So in general, if you allowed the access to such content, it no longer remains in the boundry of privacy. Also regarding copyright issues, it is permitted to use other's work if used for non-profit purposes. Under the "Fair Use Act", Section 107, "the reproduction of a particular work may be considered “fair,†such as criticism, comment, news reporting, teaching, scholarship, and research". All my activities on that thread were legally justified. I had also a Disclaimer on my thread explaining all these. I have never ever vilified or defamed my beautiful Nepalese girls. Matter of fact, the whole thread was created to celebrate the Nepalese beauties. I would rather kill myself than disrespect my beautiful Nepalese girls. It was truely meant to glorify their beauty. Also if you go through the disclaimer of Sajha, you would read a line "POSTINGS THAT HAVE BEEN MISLABELED OR ARE OTHERWISE DECEPTIVE. WE EXPECT THAT YOU WILL USE CAUTION AND COMMON SENSE AND EXERCISE PROPER JUDGMENT ....VIEWING KURAKANI." So it's really upto the viewers to take anything seriously on what I write. Sometime I tend to exaggerate. Have fun !

All the long winded argument from NAS does not authorize him to legally display these pictures on this website. By accepting the terms and conditions, the users of facebook or Hi5 may have given the rights to these website to use these pictures for marketing and other purposes. But if facebook or Hi5 were to use these fictures inappropritely (say creating a suggestive or porno website), their sorry asses will be in jail in no time. In any case they may have granted the right to use their picture and content to facebook or Hi5, certainly not to NAS or anyone else. This website is used by a close group of people so we can get away with such stuff, but if this were a hugely popular (I mean general pupulation, not just Nepali community) website, you would be asking for a lot of trouble. At the bare minimum it is a copyright violation if you do not cite the source of the picture. So argue all you can NAS, you may still not be on sound legal ground. Talking about the morality of the issue, it is a creative at best (in a crooked sense) to assume that just because someone posted a picture on the web for their inner circle of friend, they want it to be splashed all over. On the ligher side, some of the picture are gorgeous and I sure enjoy seeing those. As Dekchi Bro said, argue as much as we want to, we are still peeping Toms.

hey ANS bro, we have just posted the pics of the girls to appreciate their beauty. I dont care whether its legal or not and I dont think i did any crime by posting these pics. but you are really concerned about Nepalese women. ANS think about the women in nepal. nepal ma women haru india ko prostitute center ma bechinchan, boksi bhanera kati jana la torture garchan, school jana didainan. if you are really concerned about nepalese women go do something for them. yo mula website ma aayera, nepali keti ko privacy, legal illegal ko kura garnu ko satta testa pidit nepali mahila haru ko lagi kai gara. if you can't do that then stop posting this kind of thread. no one is going to give a shit about you and your thread. hami ta photo post garchau baschau. timro tyo mula legal illegal privacy ko kura ta mero chak bata niskine pad jastai ho. aayo pad, gayo pad, pad ko lagi k ko bat. so stop posting this kinda shit. and NAS keep going bro. i am with you
