Hello Frens, OPT extension is worse than H1B because you should not be allowed to have unemployed more than 30 days, and if you loose your job you should find another E -Verified company within 30 days. Here is exact word that I got from my international adviser. If you then become unemployed you only have 30 days during the STEM period that you can be unemployed.  You would have to find another E-Verify employer before the 30 day limit in order to be in status. So, I decided not to extend my OPT....

if u already used ur 60 days of unemployment in regular opt, then u have left only 30 days. otherwise you have 60 days to remain unemployed in extended opt. total unemployed days including both regular and extended opt cannot exceed 90 days. but u can have 60 days of unemployment in either of them. I would say look into it again. btw how many days u have in H1B, when u get laid off. I heard there is NOT ANY !!!!

The worst thing is that you cannot work for non-e-verified company in the extended OPT period. Also to extend the OPT you need to have a job in E verified company.

Hey Samosa bro, Please read this: 2. Periods of Unemployment During OPT DHS regulations currently define the period of an F-1 student's status as the time the student is pursuing a full course of study at an SEVP-certified school or engaging in authorized post-completion OPT. 8 CFR 214.2(f)(5). They do not specify how much time the student may be unemployed, making it difficult to determine when an unemployed student on post-completion OPT violates the requirements for remaining in F-1 status. As status during OPT is based on the premise that the F-1 student is working, the re must be a limit on unemployment, just as the F-1 student's period in school is based on the premise that he is actually pursuing a full-time course of study, and there are limits on how often the student can reduce his course load. An F-1 student who drops out of school or does not pursue a full-time course of study loses status; an F-1 student with OPT who is unemployed for a significant period should similarly put his status in jeopardy. Therefore, this rule specifies an aggregate maximum allowed perio d of unemployment of 90 days for students on 12-month OPT. This maximum period increases by 30 days for F-1 students who have an approved 17-month OPT period. In addition to clarifying the student's status, this measure allows time for job searches or a break when switching employers.   Source: http://www.uscis.gov/propub/Pr...

2 Month gap before Opt Starts+ 3 month = 5 month will be good if you could get a Job ... Jut make sure to start your OPT date after 2 months of completion.   All the Best guys!!   NepaliThita     Last edited: 10-Mar-09 12:43 PM
