In the event that an executive order  is signed on January 20, 2025, the following guidelines will apply: U.S. Citizens Who Filed for Spouses Before January 20, 2025: Petitions filed by U.S. citizens for their spouses prior to this date will remain unaffected and will continue to be processed under existing laws, including 8 U.S.C. § 1154. Lawful Permanent Residents (LPRs) Who Filed for Their Spouses: LPRs who have filed petitions for their spouses may experience extended processing times for their spouse’s immigration case under the family-sponsored preference category (F2A, governed by 8 U.S.C. § 1153(a)(2)). Formal notices will be sent to affected applicants to inform them of any changes to their petition status or processing timelines. Under current immigration law, LPRs are generally required to meet a 5-year residency period (or 3 years if married to a U.S. citizen) to qualify for naturalization under 8 U.S.C. § 1427. However, if the executive action imposes a 10-year residency requirement for LPRs to become U.S. citizens, this could further delay their ability to sponsor spouses. Exceptions for U.S. Military Personnel and Government Officials Overseas: Consistent with existing laws, including 8 U.S.C. § 1101(a)(27)(D) and 8 U.S.C. § 1440, the executive action is expected to include exceptions for U.S. military personnel and government officials stationed overseas who are married to non-citizens. These exceptions will ensure that service members and their families are not adversely impacted by the new policy.
