A prediction for 2019: Victory for immigrants with Deferred Action for Childhood Arrivals and Temporary Protected Status. President Trump’s efforts to end the DACA program have failed. Designed to protect undocumented youth, the program continues with renewals available. Federal courts have ordered Trump to keep the program in place. The U.S. Supreme Court will decide soon whether to hear the government’s appeal from a pro-DACA decision. The court will likely decline to hear the case, letting lower court decisions stand allowing DACA renewals to continue. If I’m wrong and the court takes the case, I expect the justices to allow DACA to continue. DACA is an enormously popular program. The public rightly sees it as fair and just humanitarian relief for innocent victims of a failed immigration policy. Courts don’t want to place more than 700,000 working, studying, immigrants in danger of deportation. Moreover, the government’s position is weak. It argues that President Barack Obama had no authority to grant DACA. Historically the courts have given the President great latitude in enforcing immigration laws. Trump may be able to win in court to end DACA but he’s needs a better argument than that Obama didn’t have the power to grant it. TPS is another area where I expect a victory. TPS allows nationals of countries where civil unrest or natural disaster makes return home risky to stay in the United States. It is up to the Department of Homeland Security to decide which nations qualify, but it must do so fairly, consistent with its own regulations. Trump’s DHS thinks it can end TPS no matter the facts. A federal district judge thinks otherwise. Unless a higher court reverses that judge’s decision, individuals from El Salvador, Haiti, Nicaragua, and Sudan will get status extensions through 2019. As with DACA, we have a group of deserving immigrants seeking relief. And, we have a DHS that failed to provide the careful and fair review of country conditions required by law. Beyond the courts, I see a long-shot possibility of legislative relief for DACA and TPS-holders. Congress may make DACA and TPS part of a package that includes increased border security.
