Sure you can file for H1B and also GC as long as your employer is filling to do so. H1B is a lottery and not sure if you get picked up. However, at the same time, you can file for GC under EB2 or EB3, and hopefully you can get GC in 2 years if everything goes smooth. Try to minimize the risk of getting RFE by providing detailed informations. Do some reseach on how to avoid RFE, it cann't be avoided completely but minimize it if filled properly so that your processing time will not be affacted. Be aware that it should be processed while your TPS is valid.

OK. I don't think you have to go back home for AOS. I have few friends who got H1b and are in GC process without having to go back home. Lawyer lie pheri ek chodi clear-cut sodhnu bro. Ma pani TPS ma nai ho...I-485 pending.
