What does your lawyer say now?

Well, I have appointment with the lawyer tomorrow. But all research suggest, that unathorized work of more than 180 days will result not adjusting the status or change in status. I am surprised that there are not many people who got in this situation. This RFE is killing me. If anybody been in this situation, please share what is best approach. Thanks in advance.

@8848m Actually I could not understand your situation. What do you mean that your OPT, EAD and work history don't match? How did you work without authorization? Do you mean that you worked for more than 20 hours in student status using your SSN without authorisation?

Yes, I had OPT on associate degree, started a job as manager and continued it. OPT expired but continued the job till Bachelor's degree. Filed EB3 after bachleor's degree completion from new job using associate's experience and got RFE for working more than 180 days in the gap period without authorization  i.e."Between Associate's OPT-new OPT after Bachelor's degree." Did you use that experience that you gained during the " GAP period without employment authorization" for you eb3 application as in " experience required for the professional category?

Had to. Because, there was no other way to show the experience gained for the future job. Lawyer initially adviced, that should not create problem.

Ganesh in your case you are fine , The only reason 8848 is in trouble because he used that unauthorised work as an experience to build his perm case. in your case you left usa and came back so the 180-day limit resets right there regardless.If I would be you I would write no on the ocean city days for work history. 8848, I think your lawyer did mess up, if somehow you can prove that the unauthorised experience was less than180 days you might have a chance. Talk to a really good lawyer. and keep us posted.

All बुल्ल्षित and लेग पुल्लेर्स. consulted many lawyers, both free and with charge. spent 2500 + in lawyer consulting fees. none of them said they can suggest jhuto bolna. then luckily someone in similar boat shared her experience. did same Ani sabai kura bhayo without any hassle. Big Big Gratitude to that person. Couldnt resist not replying to this thread coz dont want others to go thru same hassle as i did in lack of this simple info. Hope this helps. sab waiyat ho niyam kada bhanne , Niyeam as in LAW has not changed a bit. In the OP's case here though , usko yedi kam less than 180 days raicha bhane chai he will be fine. Uskoe eb3 2 barsako experience yedi tyo bina nai pugcha bhane , kam gareko chaina bhaenra prove garnu paryo. THe most import thing is not how much you made its how long you did it. Remember 180 is permissiable. But in your case since you used that 180 as a part of the perm experience you might be in a problem but talk to a lawyer ASAP

I am not a lawyer but if you put "No" and they find out , you're in huge problem. That's all. I wouldn't lie. If you've worked less than 180 days since your last entry to US , you should be fine. The key here is "since your last entry" . Once you go out of US and come back then it resets it and most people get away with it.

@8848m, I have a situation like yours.I worked without proper authorization for 3 months and i used those months as a part of PERM experience. Did you mention that you worked without work authorization when filing I485 ?

Mero personal experience and maybe useful to those who will file their GC through employment. 1. Do not trust your lawyer 100% on this process. Do your research on your own. Our Nepali community is small but find Desi sites and you will find thousands of cases similar to yours. In my case, my company decided to use a third party lawyer and after filing the PERM, I found out that she had made a mistake (something to do with EB2 vs EB3). got lucky and approved Then she made another mistake in i-40 but this was corrected. I had to spent few $$$ from my pocket to consult with different lawyer. 2. never show your work experience without proper authorization in any government related paper work or process. This is true for resume too if it is being presented to USCIS or any government related applications. This might come back to you to bite you (even after years of getting GC). It is a simple common sense. I have not read the whole reply from others. But in my case I worked for many years without work permit in check, filed my tax every year. but during my GC process I never showed those work experience. When you write those work experiences (without proper authorization) in your paper work, you are clearly giving information easily at their finger tips that were illegal and will be used against you easily. Some might argue what if they find later. But its not easy. IRS is independent of USCIS and DHS and they don't work together. IRS doesn't care if your are legal or illegal as long as you file your taxes properly. IRS is all bout collecting $$$$$. I have many many friends who worked on check without proper authorization but never mentioned those work experiences during GC process and I have never heard that USCIS found out. Hope this helps.

ma yeha sarkari thau ma kaam garchu jaha bata kahiely kahi citizenship nabhaako ley kaam gareko claim garyo bhaney inquiry submit garnu parney huncha INS ma. But we just do that inquiry for the period entered by the user, to check if that is in valid EAD time frame or not. I can not guarantee other firms do the similar inquiry but when you provide the timeline, most likely it is automated process. Fetch the duration from form, send inquiry for the validity . So I totally agree with what STUPIDA said .
