Hello expert My question is regrading TPS TO green card...... I am currently working in a three star hotel as Assistant General manager, They are trying to promote me as GM with in six month. I have done MBA from United states, but i never applied for OPT. Now My company ready to sponsor my green card, they have multiple hotels, motels, Convenience stores and housing. My Boss, by profession he is Doctor, Indian origin us citizen but his company never sponsored GC or H1-B visa to his worker. Company has profitable tax filing status. He is flexible to change my work title while he file status for example: Indian Cook, or IT manager, According to TPS There's no route to GC However, you may now be, or later become eligible for a green card on some other basis. This could be, for example, because of marriage to a U.S. citizen, a job offer and sponsorship by a U.S. employer, or a grant of asylum. can I file directly Green card ? or still i need to file H1-B? You don't need to H1B to apply for green card. You can probably go through labor certification. IDK how easy it would be go with cook/manager. You have to prove that there is no local US candidate who can do the job you are doing and you cannot use any experience that you learned on the job as a requirement. I would check the website http://dolstats.com/ of approved labor certifications. I have seen cooks and managers as a profession that has been approved. I work in IT and am in student status and doing my GC through I-140.

@m00se I have been working with state government in permanent full time position for past 3.5 years and they are willing to sponsor me for a GC while I am in TPS. So, do you mean I can't use 3.5 years of experience from this state job and I have to use experience before joining this job?
