Hello All, I am just passing you a message. I am not here to argue or agree or disagree, It is purely my opinion. And we all know opinions are never true and never false. It is purely subjective. That being said, I have a friend who had an asylum case (genuine) at San Francisco Immigration Court, represented by a Nepali attorney named Yagya Nepal. Yagya is in Bay area, his office being in San Leonardo, CA. Yagya has screwed my friend's case. You may wonder how? 1. Her individual hearing was scheduled to happen within 2 months. Yagya Nepal filed a petition saying that his client (my friend) could not gather enough evidence or documents thus requested the SF Immigration Court to rescheduled her case. As a result, since the attorney represented the client, the court rescheduled for another date and gave 3 years further date in 2019. My friend did not have any knowledge nor had any consent or discussion for this. She has all the documents for it. Later, it came to know that Yagya Nepal planned to go for a vacation in caribbean with his family at the time of my friend's individual hearing. Thus, he just requested the court to reschedule the hearing without any planning or discussion with his client (my friend). 2. When my friend knew that (she pretended that she does not know though) requested Yagya Nepal to file a motion for advance hearing citing that she is in depression (which is 100% true, do not want to disclose her mental status). Yagya Nepal did not agree in the beginning but when he found that he might loose a client and definitely money from the client, he agreed to work and tried his best to do delay in the filing so that he would not miss the vacation he already planned. However, my friend did her best and gather all the impossible documents he asked for because she is a genuine Victim and she had all the documents Yagya needed. 3. Now Yagya as he find that my friend gathered all the documents, started bargaining for the court case fee which was already agreed and documented and signed by both parties. Both have signed and agreed that for this particular case, certain amount will be paid to Yagya. 4. My friend has been patient and now Yagya started emotionally blackmailing that he will not fight for the case neither he will file the motion to advance the hearing if the agreed upon amount is not reevaluated. 5. I do not know what to suggest my friend. She was in a deep depression already as I stated she is a genuine asylum case and the victim of the crime back in Nepal. No fake here about her and her case please. 6. Please suggest what to do next since this Nepali Attorney is playing with her situation and innocence. 7. Only positive response is expected rather than roundabout or criticism. If you cannot stand with a person in need, then you do not have right to criticize at her situation. Please guys, be quite or be positive. It is genuine. 8. You can PM me if you have to disagree or argue or vomit negative criticism. It is about an innocent lady who had been several time raped during the Maoist era, her few family members were killed in front her eyes. So please respect that before you make any comments.
