It depends upon your current immigration status. what is pending asylum means (case in court or waiting for interview)?

@facebook Kya tension......parole ma jannu mildaina??

Pending asylum applicant can apply for advance parole and travel.

Catch 22: u cant stamp ur H1 while traveling on AP.

bairaghi · Jan 20, 2016 1:11 PM

You can take risk of course but ask any lawyer they wouldn't recommend it. There might be some case of returning but totally depends on your POI officer.

no even with advance parole, you will be self deporting yourself in removal proceeding hence getting yourself 10 years ban, get voluntary departure or administrative closure of the case before leaving county in AP if you are in removal proceedings...that is what i have found out from all the reading i have done..follow this document:http://www.uscis.gov/sites/def... tyo afno country nagayikana pani h1b adjust garna milcha bhanne suneko thiye tyo kun case ma ho ??

samrock · Jan 20, 2016 3:23 PM

U applied for asylum after ur J1 expired. So that is the problem. I wonder if u can adjust through H1. U r technically in out of status. If u had applied for asylum before ur J1 expired, u will be technically under status and could have adjusted through H1 by going to Mexico on AP and getting H1 stamped.

If you are in removal proceedings, no mater what document you get or no matter what approach you take to get GC( except for marrying us citizen or family petition by family relative), you need to getvoluntary departure or administrative withdrawl of case before leaving country. http://www.smartimmigrationlaw...

I got my AP through TPS while I was in removal proceedings. I have sent the motion to the court to administratively close my proceedings. DHS didn't oppose my motion based on grant of TPS and no criminal history. I am planning to travel on AP. My lawyer said, i will get a 10 year ban. I read about the Matter of Arabally, that i will not trigger 10 year ban upon leaving and returning on AP. How true is that?

furke · Jan 20, 2016 4:16 PM

Based on ur other posts, ur only options are win asylum case or marry a citizen. Present more+stronger documents to backup ur asylum case. It can be done. If u dont mind, How u got misdemeanor ? DUI ? U cant be that stupid when u have such a fragile situation. Otherwise u could atleast have TPS by now.

bairaghi · Jan 20, 2016 4:17 PM

@ Bairaghi bro!! Tehi ta problem bhayo. Lawyer le waver file garnu milcha banecha TPS Ko Lagi. ..kunni??I'm still waiting for the outcome of the TPS application. Btw my other DUI is still pending.

If you are in removal proceedings, no mater what document you get or no matter what approach you take to get GC( except for marrying us citizen or family petition by family relative), you need to get voluntary departure or administrative withdrawl of case before leaving country. So whatever you do(except for marrying citizen) ..everything comes to stop at AOS  Last edited: 20-Jan-16 05:20 PM
