I've an Appeal pending in the Circuit court for my denied Asylum case by the immigration Judge and BIA. I'm just worried about the out come which will be in next 1 or 2 years, If case is remanded it will be sent back to Immigration court and if dismissed I'll be deported. I came in J1 visa. I've also applied for TPS, but unfortunately had another misdemeanor recently which makes me not eligible for TPS. I'm seeking information from individuals who has experience the same and had found other alternatives to stay in US..like employment based opportunities etc.. Any information leading to overcome this obstacle is truly appreciated. Please share your story or someone you know in the same situation, who made it in US. Please help!! Sabai ko Jai hos!!

You may seek to administratively close proceedings & wait until immigration reform or marry US citizen. Or if you become a victim of a crime, U visa. I highly doubt you qualify for employment based if you have unlawful presence.

It was denied for not meeting the burden of prosecution and inconsistency. Still have an EAD, Asylum is still pending outcome the decision from the Circuit court. So no Employer can file Green Card for me under these situation??

Ok. Did you file within one year of last entry? To adjust status through employment, i think you need to have some sort of legas status. Not too sure tho..

Was your appeal dismissed by BIA already and u r now appealing in circuit court? On your appeal, did you mention about changed country conditions after the earthquake and you would be more vulnerable to persecution than before?

@ Furke, Yes the BIA affirmed the Immigration Judge decision not meeting all that burden crap. and it took not too long for BIA to affirm IJ's decision. I was told that it might take couple of years for BIA, but they ruled out in 6 months. yes I did file it within one year of my entry to US.

Thank God, I just got an update on my pending appeal from the circuit court on my asylum. Unopposed Motion to remand case filed by Govt. Attorney. Hurray!!!
