F-1 Status

I came here 8 years ago. I finished by Bachelors degree and i am in the process of completing my Master's degree. Recently while traveling from Arizona to California i was stopped at the border patrol check point and they told me i was illegally here and threaten to deport me. I have always maintained my status. I had to argue with them for about 1 hours and they went through every possible way to prove i was illegally here which they couldn't prove it. Before they let me go they say my F-1 status has to be re-evualted and i have been reported to ICE. What should i do now? What are the things i can prepare to show i am here legally?

Bro, hire a good immigration lawyer, s/he will help you get out of this problem. They range from 500 to 1000 in your case not more than that. Good luck

Sorry to hear about your experience with the Border Patrol. I do not think there is any such regulation that F-1 has to be re-evaluated after 8 years or this many years. Some schools might re-evaluate F1 status of their international students, but these are the cases where the student might be enrolled in the same college for, let's say 7 or 8 years when the anticipated duration of the degree might be 4 years standard or 6 years at the latest or the student might jump between different majors or is performing poorly in academics - none of which applies to your case. There is good deal of chance that the CBP agent was not well informative on academics based immigration statuses. Refer to the following link for difference between USCIS, CBP and ICE: https://help.cbp.gov/app/answe... Had they been a USCIS agent, things would have gone a different and positive path. The main responsibility of a CBP agent is to protect the nation's border against illegal immigration, drugs and terrorism. Given the region where you encountered them, they are used to dealing with preventing illegals and drug and human trafficking rather than administration of immigration services. My question to you is, has ICE asked you to provide them with any documentations or proof of your valid status? If they have or even if they haven't, my suggestion is to consult with your school's immigration office representatives. They will be able to guide you better and suggest if anything needs to be on your/their part. Finally, I do not think you need to worry about this. This is a case of a simple lack of knowledge in the CBP agent's part and frequent unfortunate harassing that occurs in that region.

Thanks for your reply. I had a chance to sit down with the international student advisor. She went thru my SEVIS and everything is valid and i am in proper status. She actually told me that was a harassment from Border control agent and asked me to file a formal complaint against the agent. Me being very nervous at the time didn't noted the agents name. But as far as now all is good and i contacted the ICE thru phone and they mentioned that it might have been a case of misunderstanding.

complain bro and tell them you haven't been able to focus on anything. i bet you are still in trauma after the situation. don't want to drag this too far but you had every option to file a complaint and ask for compensation as well.

Good Luck with that. I would not go that far on suing them because its just a matter of misunderstandings. I would just a write a letter to the Head of CBP at the concerned post. Until and unless you carry a American passport, we would be harassed for little to big immigration task. It could just be renewing your driver's license to filing Immigration benefits such as I 140, I-485. Just know that if you are travelling to area were illegal immigrants are rampant, Please carry proper form of visa, I 20 or continous enrollment letter from DSO.
