None of them is true. Only rule is that Asylee cant travel back to their home country. IF found doing so, their asylum status will be terminated. And US government doesn't provide us with American Passport when we asylum application is accepted. So basically, if this new rule comes in action. All Aslyee are stuck here in US and Cannot travel anywhere in the World.

There is a thing called travel document which all asylee should qualify. You should be able to travel to any country with that. Its like a US passport but you need the visa. Will not have problem re-entering US

Refugee status or asylum may be granted to people who have been persecuted or fear they will be persecuted on account of race, religion, nationality, and/or membership in a particular social group or political opinion. Now using common sense: Why on Earth you need the passport of the country where you can not live? In English: If you say that you are no longer safe in Nepal and want to live in US why should you need a passport of a country that can not protect your life? If you need to travel to different country that where you have filed asylum; see Oh_gaathe's answer.

Well, just because you are granted an asylum to another country, doesn't mean you get a citizenship (and hence passport) of that country. What would then the asylee do? Passport is not to go back to Nepal, but to travel to other countries so from that sense, it does make sense to retain the passport of the original country until the asylee has a new passport.

asking for asylum means telling govt of annother country that their own country could not guarantee their safety. Thus asking for a place to live and start a new life without fear of returning to the home country. Using passport from home country means that the person trusts his/her govt to provide safety and other diplomatic help incase of emergency. Asylee should not use passport of home country, instead they can be issued travel document and can return back safely. If true, this is sheer stupidity in part of Nepal government. Just because someone gets asylum in another country, that person does not cease becoming the citizen of the country of origin. This is a simple fact, isn't it? By not providing the passport to these folks, Nepal government is either unilaterally revoking their citizenship, which it cannot do as per UN convention it has signed against statelessness; or it is creating two classes of citizens, one entitled to the passport and the other not. What kind of monkeys are running the country these days?

This is to discourage fake asylees. The real asylees, bhutanese, are not given nepalese passport, I guess. So they are not worried about nepalese citizenship or passport. I guess most of the so called asylees (maoist pidit) are fake. The real maoist pidit are still back in nepal.

How can you justify denying rights of one genuine refugee by adopting a policy to discourage 99 fake asylees? On the other hand, will it really deter people from seeking asylum? Has everything to do with travelling other places. Think about it, someone threatens you and you have to leave your country as an asylee. But you have to travel to other countries; there's a good chance you will get travel documents from the asylum granting country, but if not, you still have a choice to use your passport. Has nothing to do with your feelings towards your country. What you are mixing this with is the question many asylee ask about returning to their country, specially those who obtained asylum via illegit documentations. This is not the same case (I made that mistake on assumption as well).

The nepalese government knows most nepalese asylees (not bhutanese) are fake. That is why they took this step, I guess. :) By the way after staying in america for 5+ years, don't these fake asylees get american citizenship? Or they become asylee in america for the rest of their life? If they want to travel to Nepal when they are asylee in america, does US allow to do that? Or these fake asylees go to India and sneak into Nepal? I think most asylees after getting greencard don't go to Nepal directly. They go through India their whole life I think. They can retain their Nepali citizenship and US Permanent Residency for rest of their lives. Why does it even matter what they do with their private lives? But there's gotta be time limit to when they are not allowed to trave back to Nepal. It cannot be rest of their lives. Once granted US citizenship (if they choose to take up one), I don't believe they would be bound by such rules. All US citizens would and should have the same rights. Having said that, if their fraudulent asylum application is ever discovered by the authorities, they can revoke their citizenships and subject them to criminal proceedings and of course deportation. Must be Nepalese embassy getting a lot of passports from nepalese asylees and that raised a question. It is illegal for embassy to issue passport to fake asylees I guess. I think 100% of all nepalese asylees are fake fake ( not bhutanese)

@kiddo if you look at the very first thing in page no 1 of nepali passport you will see The ministry of Foreign affairs request and REQUIRE in the name of governemnt of nepal all those whom it may concern to allow the bearer to pass freely without let or hindrance and to afford him or her every assistance and protection.... Asylum is based on braod UN mandate and most of the democratic countries are signatory, so most countries are obliged to provide to give refuge if applicant prove the fear beyond doubt. As like eth else countries try to make it harder and mostly they do not want flood of people. So they make asylee as second class citizen without giving them full rights. In america its different immigration is based on humanitarian approach, so they give asylee green card after one year and citizenship /passprt too. But thats not the case with other countries so 150 sth odd countries are required to provide refugee travel document. Its not like they want too. I know if any country don't want to, then it will simply say thats a diffferent story. Heres the difference, asylum is broadly general everywhere but what to do with the displaced is based upon the host country's capacity and will. Nepal ma tetro aayeko haru bichara lai nepal sarkar ka ghusyaha neta haru le k hi garennan. And they were moved to USA. And about travelling with green card, it is only for return to america like a visa. Nothing else. If you ask for asylum first question would be why you are asking me, but not with police of your own country. If you have own saranarthi that means you have already declared timi lai timro sarkar ma bharosa chhaina bhanera.

Nepal government should have taken this action long time ago...but good they're doing now..... Most of the nepalese students who come here in F1 apply for Asylum and that's fake...and i believe illegal...One shouldn't follow that path..do the right thing. US government needs to know that and revoke their asylee status and green card and send them back home ...that's what i think is the right thing to do. Do the right think and you'll be fine. . fraud will come hunt you down..... Yes...say whatever you want to say now.

If you still have a Nepali rupees, any denomination, it says "नेपाल सरकारको जमानत प्राप्त यसको रुपैया भुक्तानी माग्न आएमा नेपाल राष्ट्र बैंकबाट .. रुपैया तुरुन्त पाइञ्छ." I don't see anything wrong when F1 students apply as students and mentioned they'll return back once the degree is complete (it's the intention at the time of obtaining visa). At that time they had "intention" of going back to Nepal after they finish their degree and the "Intention" changes after they finish their degree so they apply H1b and get green card through legal process such as Eb2 which is not similar to getting green card by faking the asylum and lying that they're in danger when they go back to Nepal. They're two different things. You can't say F1 students lied at the time of F1 interview when they said they had intention of returning at that time and that intention may change after they come to US... It's like you get your green card thru your Employer and people change jobs after working few years. So it's the intention at the time of applying green card through Employer. "Employee had intention working for unlimited time for the employer when he/she applied for green card". But that intention might change and they're allowed to change the employer. Asylum fraud is a severe fraud. I have seen most of the students going through that route in past few years. They go to states like California and apply asylum mentioning maoist threat which maybe true in very few cases but most of the time it's not. and it's true most of them travel via india. Let's see if Nepal government does what they're saying now or they change the policy again.

After reading all these opinions, I feel like we Nepalese don't want to see other getting the things which are not able to or we already have. What's wrong in getting green-card through Asylum.If American government is granting,anyone can take that. It is US government to decide whom to give and whom not to,not us. Don't forget that our country still runs from huge portion of remittance and obviously some portion of that is contributed by most of the green card holders in USA. We students can't send a SHI*. You guys can fight and argue all you can but its everyone right to file for asylum. I have seen this argument too many times. First of all, I support your claim on getting a passport; even though from a nation's point of view, if my citizen is leaving me and seeking asylum from another country, I really shouldn't care about giving him/her any document, be it passport or anything else. I supported it because genuine asylum seekers will be at a serious jam for no fault of their own. Now talking about envy and people criticism, well you should expect that. I wouldn't necessarily call it envy. Say, there is an apple tree and everyone is eligible for the apple as long as they put in an honest day of work. You work your ass off and go collect your apple, while Chankhey there is just sleeping idly through out the day. Then he goes and gets the apple, lying that he also was working the whole day. Be honest, you will feel a little mad about Chankhey gaming the system and getting the apple. That's not envy. Sure if the gardner is dumb enough to believe Chankhey and grant him the apple, it's his fault, but you still feel a little irate, woudn't you? As for Criticism, you can't expect people to keep quiet when somebody asks a question like how an asylee can get entry back to his country w/o losing the asylum status. As much as you have the right to that status, the critics have right to criticize the way you have gotten it. Hope you got my gist.

I have known about 10 of my friends who received their green card via asylum. To the best of my knowledge, all of them filed the asylum since they were thrown out of the school because of poor GPAs. This poor GPAs are the result of their negligence (drinking, moj masti, gaaza etc). Nothing more to say. And now, they complain they cannot go back home blah blah blah.
