Hi, I am in H1B and I am planning to start for EB2 processing. I came to know that either I need to start immediately or need to wait till the end of fiscal year ( july). I work for indian consultancy now, so wont be surprised if I am given wrong information. I talked to their lawyer, and that is what he said. He said, they need to submit some form for prevailing wages which takes around 60 days to get processed, and that expires with fiscal year ( fiscal year ends in june/july). Labor cert cannot be filed after prevailing wages expire , so the processing has to be started again from the begining. How true is this? and if possible, any one has some idea on the steps and the expected time frame? like for prevailing wages, advertisement, labor certification etc. Thanks for your time.

I am in OPT and my company is filing PERM in couple of month. As far the Prevailing wage goes it will be update every July 1st so any Prevailing wage obtained before that will expire july 1st and you wont be able to file PERM with that wage. So good idea would be to file PERM before July 1st. As far as my lawyer told me PERM is talking about 7 month these days given that there is not audit. IF there is one your case will delay by at least 6 month that's like a 1 year with audit. Again we have to add 60 days waiting period of job posting before filing perm I-140 is just 2 weeks if you are willing to do premium processing -$1225 I-485 is 4 month for Nepali. So we are looking at at least 13 months without PERM audit and 1 and half year with audit. And remember 30% of the PERM application gets audited. so good luck.
