Folks, I had to quit and visit Nepal in the middle of the project due to family emergency and the Indian consultancy that I was working for us refusing to pay me, saying they haven't received payment from my vendors. Has anybody ever reported a consultancy? How do I go about suing them? My hands are tied as I'm in Nepal. Btw, I'm a US Citizen. Thanks.

Refusing to pay, or even delaying the payment is a crime. You are already eligible foe compensation. Just what I think, btw.

I would say get touch with lawyer, and dream for several thousands if not million dollar compensation. Again, strongly suggest to get a lawyer with all the proofs.

If you have worked, you are entitled to receive the pay that in stated in your employment contract. It does not matter if you break the contract or anything else - you are entitled to that pay. If the consultancy is not paying you and are saying the client hasn't paid them (which is hard to believe), the consultancy is liable by law to pay you because you are an employee/contractor of the consultancy. My suggestion is, talk to the management team of the consultancy and explain them that you will be forced to get legal help if they do not pay you the amount in the contract. I am sure there are many lawyers out there that will be interested to take your case because it will be an easy commission for them. Good Luck!

You were bound by contract to work and you quit yourself thus breaching the contract. So maybe they can hold your wages to compensate to train and replace the employee.

There is no contract that can bound you for any family emergency. Even if you breach contract, they need to persue legal action. Withholding wage can't be justified in any way, assuming that you are W2 employee not 1099 contractor. I was in similar situation earlier. All I did was , ask for pay , with formal email, giving them 10 days to clear all dues. They ignore my email, then I fill filled wage claim form from state DOL office, and send it to them, if it didn't get paid in week, I am going to file case with state DOL. I got cheque in 5 days. If they didn't pay just file claim with DOL, it's easy are free. Keep following up with them, it takes time but you will get paid.
