 यो पुरै प्रकरणमा माओबादीले अनावस्यक रुपमा न्यायलयलाई तानेको छ. यस्तो समयमा प्रधानन्यायधिस जस्तो मान्छे ले न्यायलयको इज्जत जोगाउने काम गर्नुको साटो आफै लोभमा फसेर नेपालको कानुनी सासनको धज्जी उडाउने काम गरेका छन्.

We need to understand maoists want to destroy every strength of Nepal. First their only demand was to remove king. Then, they tried to attack our symbols such as country's name "Nepal", country's flag. They want to erase any symbols that unites us and makes us strong. That's why they brought the issue of Prithvi Narayan Shah and everybody fell in their trap, and now PN Shah is no longer a symbol of unity for many people. There was social (religious and ethnic) harmony among people. They started the fire that would/could ignite any of our bones: who started terai-pahadi war who started hindu-other religion tension? who started jatiya jhagada? Still, people had faith on army and there is no scarcity of crooks among nepalese. Next, prachanda as a dog threw his bone and another crook named Khadka wanted to sell whole Nepal army to maoists. Many decisions that maoists made were hindered by our justice system, and they were openly opposing court's ruling such as murderer Bal Krishna Dhungel's case. Even Nepali Congress went to oppose court's decision to arrest corrupt Khum Bahadur Khadka. But people still had faith in our justice system. But, maoists at first opposed our justice system and said executive power should be with the PM, above the justice system. Few months back, maoists were fighting with justices. But now, they have started another trap to destroy our justice system. And this dog, our chief justice has falled into maoists' trap. I can't imagine the reactions of people when courts make controversial decisions again. This chief justice seem to be very greedy person and is another bad guy in Nepal, and is soon going to make a history by becoming the worst guy in our history.

 I think Mr.Regmi is not Looovi and a opportunist as medias have declared him.This is the only best idea Prachanda has come up with since his birth to make him PM to solve present political misfortune.The Constitution of Nepal has clearly stated that Cheif Judge can take part in any role that deals with Rastriya Sarokaar,so, isn't solving this crisis and giving country a good exit from this mess a Rastriya Sarokaar?.Its never easy  task when you have  to choose one between rotten apple and rotten potato as we have already seen from long time the inspiring and achieving acts of our monkey netas,making Mr.Regmi a PM is not a wish but a necessity.I feel its his duty and his resposibility being a Nepal ko Choro to take the PM post that has bestowed upon him and gather all the monkeys of all parties--who will never form any agreement-- and do the election safely till the country comes back in political track.All the best to him.

 aawara, I hope and wish you are right. That would be the good scenario. But I see the opposite. How is court going to decide on the cases against the government decisions led by its own chief justice? We saw that court helped to bring the government in track. Now who is going to do that? Is supreme court going to make a decision on the writ preventing chief justice to become PM?  What happens when CJ-led government fails? Are we going to give the next contract of our government to India? Isn't all that loktantra for multi-party system? Are we heading to no-party system? Does it surprise you that Kamal Thapa was the first one to come and support this no-party system? If they really want the good person to led, there were many ex chief justices with no affiliation to any parties. But no, maoists want to mingle this so that they can revenge on our justice system, the only faith we've left for, and the only strong entity left in Nepal. Why don't/can't we see that maoists want to destroy each and everything that unites us and make us strong?  He should stay away from this mess.  He will lose all the reputation he has built over the years and lead country to the biggest catastrophy ever. Justice system should be free of politics. I am alarmed that people are quiet about this issue or they do not understand grevity of the situation.

 http://weeklynepal.com/index.p...   एक्लिदै प्रधानन्यायाधीश! युवराज घिमिरे -- संस्थाहरू ध्वस्त पार्दै रिक्तता र अराजकता बढाउने अनि सत्ताकब्जाको माहोल तयार गर्ने माओवादी चाल नयाँ हैन। एकपटक एउटा प्रधानशत्रुलाई समाप्त पार्न अरुहरूलाई आफ्ना तत्कालिक मित्र शक्ति पनि घोषित गर्दै आएको छ माओवादीले रणनीतिक रुपमा। खासगरी नेपाली कांग्रेस र एमालेको सत्तामोहका कारण एमाओवादीले बीच बीचमा उनीहरूलाई सत्ताको मह चटाउँदै आफ्ना लागि महत्वपूर्ण निर्णय गराउँदै आएका छन्।   राज्यको रिक्तता स्थापना गर्न वैकल्पिक व्यवस्था विना नै राजतन्त्र हटाउनु माओवादीका लागि आवश्यक थियो। त्यसैले गिरिजाप्रसाद कोइरालाको राष्ट्रपति बन्ने महत्वाकांक्षालाई प्रयोग गर्दै विधि, नियम र प्रक्रियाविहीन तरिकाले र वैधानिकता नै नभएको सरकारद्वारा राजतन्त्र उन्मूलनको निर्णय गरियो। नेपाली जनतालाई जनमत संग्रह या अन्य कुनै प्रक्रियाद्वारा त्यो निर्णयमा संलग्न गरिएन। किन त्यो निर्णय तत्काल होस् भन्ने चाहन्थ्यो माअेावादी? किनकि राजसंस्था संवैधानिक हैसियतमा रहँदासम्म पनि नेपाली सेना र स्वतन्त्र न्यायपालिकालाई कमजोड पार्न सकिन्न, र त्यो नभएसम्म सत्ता कब्जाको वातावरण तयार हुन सक्दैन भन्नेमा माओवादी स्पष्ट थियो।   रुक्मांगत कटवाललाई हटाउने खेल असफल भए पनि नेपाली सेनाको नेतृत्व तहसँग यता बाबुरामले मित्रता कस्तै आएर उसलाई राज्यको नभएर सरकारको या दलको इकाइका रुपमा देखाउने प्रयास भइरहेको छ। त्यो प्रयास जारी रहँदा हेटौंडा सम्मेलन मार्फत् न्यायपालिकाका प्रमुखलाई आफ्नो रोजाइको प्रधानमन्त्रीको उम्मेद्वारका रुपमा प्रस्तुत गरेर एमाओवादीले न्यायपालिकामा दलीय राजनीति घुसाउने प्रयास गरेको छ। त्यसमा कपट छ, तर न्यायपालिकाका प्रमुखले 'मौन' बसेर त्यो षड्यन्त्रको विष न्यायपालिकामा पूर्णरुपमा फैलिने अवसर दिइरहेका छन्।    व्यक्ति अनेक अवस्थामा मौन बस्न सक्छ। जब ऊ सर्वज्ञान सम्पन्न हुन्छ या क्षमाशील हुन्छ, ऊ मौन रहने साहस राख्दछ। त्यस्तै जब ऊ आफ्नो बचाउमा कुनै तर्क प्रस्तुत गर्न सक्दैन, तब पनि ऊ मौन रहन्छ। प्रचण्ड र एमाओवादी सत्ता कब्जाका लागि न्यायपालिकाको स्वतन्त्र अस्तित्व समाप्त पार्ने रणनीति हेटौंडामा खुलेरै प्रस्तुत भयो। प्रधान न्यायाधीशलाई प्रधानमन्त्री बनाउने प्रस्ताव त्यसै रणनीति अन्तर्गत त्यो रुपमा आएको थियो। अन्य दलहरूलाई 'खाए खा नखाए घिच' को सन्देश थियो त्यसमा। तर, प्रधान न्यायाधीश खिलराज रेग्मी 'मौन' रहे त्यसमा।    शक्तिका कारण? ज्ञानका कारण? क्षमाशीलताका कारण या कमजोडीका कारण? स्पष्ट हुनसकेको छैन। अदालतको शक्ति विवेक, निष्पक्षता, न्याय, क्षमाशीलता या कमजोडी उसको निर्णय या फैसलाबाट बोल्छ सामान्यतया। तर त्यो सामान्य स्थिति या आचरण हैन एउटा ठूलो दलबाट अपेक्षित। प्रधानन्याधीशलाई एउटा पार्टीले आफ्नो 'प्रिय' व्यक्तिका रुपमा प्रस्तुत गर्नु र राजनीतिक विवादमा उनलाई तान्नु आफंैमा आपत्तिजनक कुरा हुन्। बारका पूर्व अध्यक्षहरू विश्वकान्त मैनाली र हरिहर दाहालले प्रधान न्यायाधीशको प्रतिक्रिया माग गरेका छन्। न्यायाधीशहरूकै बीच आशंका बढेको छ–के प्रधान न्यायाधीशसँगको छलफलपछि प्रचण्डले उक्त प्रस्ताव ल्याएका हुन् या न्यायपालिका र खासगरी प्रधान न्यायाधीशलाई बद्नाम गर्ने उद्देश्यले? प्रधान न्यायाधीश मौन छन्। भोलि सर्वोच्चबाट हुने महत्वपूर्ण फैसला र हिजो भएका महत्वपूर्ण फैसलालाई यो रहस्यसँग जोडेर हेरिने छ। रेग्मी अथवा सर्वोच्चको आधिकारिक बयान नआउनु 'मौन' लाई 'सम्मति' मानिने छ। अब यो विषय प्रचण्ड र रेग्मीका बीचमा हैन, मुलुकको मुद्दा बनेको छ। न्यायिक मर्यादाको कसीमा यो जाँचिने छ भोलि।   राष्ट्रपति त विचरा बनिसकेका छन्। उनी राष्ट्रपति कम राजनीतिक खेलाडी बढी देखिन थालेका छन्। राष्ट्रपति भवनमा 'संदिग्ध' मानिएका व्यक्तिहरूसँग उनको लगातार उठबस भएको मात्र छैन, उनी केही विदेशी कूटनीतिज्ञहरूसँग पनि निरन्तर सम्पर्कमा रहेको देखिन्छ। त्यस्तो अवस्थामा सर्वोच्चले परि आउँदा उच्चतम न्यायिक निष्पक्ष र न्यायोचित फैसला लिने अपेक्षा गरिन्छ, कानुन, संविधान र संविधानवादको पक्षमा। तर, हेटौंडा प्रस्ताव पश्चात् के न्यायपालिकाले आफ्नो क्षमता र चरित्रबाट जनतालाई आश्वस्त तुल्याउला?

 metta,I agree in what you say and have no doubt that it is Maoist another strategem to weaken all national powers so they can maraud freely without hassel.I am not lobbying this guy and I  barely know him from past 2 days but it is the only panacea I see to solve the present conflict.The nucleus of the problem is our nepali mentality that would not take "yes' to any decisions and cannot form any agreement between themselves.The country will not move ahead an inch if the three stooges--Sushil,Jalanath,Gacchedaar--didn't  make any consensus and that's not coming till the end of the world so trick-master Prachanda has come up with such plot  to appease them--a sort of blackmail I would say.The present political scenario of Nepal is as aimless as a asteroid that's crusing in the space,not knowing the destination and looking for a catastrophe and somebody(honest and credible) must step-up to take the helm when all the political parties are rowing the boat in various directions.Anomalous decisions must be taken in critical  circumstances and if it serves good at the end to all who matters(natives) then forgot the rest ,be it a Cheif Judge,Cheif Executive,Cheif Poet,Cheif Businessman,Cheif Lawyer,Cheif Actor and so on.
