I 485 RFE on Birtih Certificate

Registration Criteria: Birth registration certificates are issued at the request of the concerned person or the concerned person's family. Despite the legal requirement, very few parents register the birth of their children at the time of their children’s birth. Birth registration certificates are often issued long after an individual’s actual birth. Birth records issued by hospitals are not considered legal documents, but can be used to obtain a legal birth certificate.

Send that above text and link to USCIS and write a cover letter mentioning.

I) Nepal custom doesn't mandate that we register the birth of our children when they are born. It can be registered late by paying a small penalty. This is the reason why Mr. Xxxxx's birth was registered late.

2) provide affidavit of birth from your Mom and Dad and from someone who has seen your birth. Sign it, notarized copy.

3) contact your primary school , ask them if they can provide old school records where your date of birth is listed. Or if you already have a old school mark sheet, certificates that's great. If no record is found, ask your school to write a letter describing your date of birth was xxxxx and was born xxxxx , show both parents name as well.

That should be more than enough.


FYI, I had received RFE as well and I did the above things and it worked like a charm!
