Consultancy to Full Time - Suggestion Reqd

Ma last 2 year dekhi euta indian consultancy ma kam gardai, yo barsa H1B chittha parera approve pani bhayo. Ma kam gardai gareko client le malai fulltime bas bhanera dikka banai sakyo, offer pani dherai ramro cha.
You need to transfer H1b to current company from Indian Consultancy. Full Time offer gareko company le H1B transfer petition USCIS ma apply garnu parcha, It's exactly like applying H1B and takes atleast 5-6 months and expensive too. Ask your company if they are going to spend all those processing fee and do not deduct from your salary. Once H1B transfer petition is filed and received receipt number, then tell your Indian consultancy that you quit your job from them.

I see two risks here:

1. If your H1B transfer is denied (should not be in most of the cases), then you are immediately out-of-status (given that you do not have TPS/EAD. SO, why do not you file TPS with EAD as backup plan.)

2. If your Indian Consultancy did some kind of contract agreement with this company who is offering you full time job, they might sue you joining this company. Go through the contarct document before jumping into the offer and resolve the issue. Do not tell the consultancy company that you are leaving them and joining this company. Act wisely to avoid legal hazards.

Whatever way you followed to get this job,once you are onboard, thats it. Your are done with the process and worry about the performance and job done on time and with perfection. Rest are tapaseel ka kura hun. As long as you are doing your job, you are safe. Be consistent in your resume. whatever you submitted during job search and interview process, stick to that. Never ever change anything from that baseline, however you can add whatever you have learned within this two years.
So, same resume with updated version of resume should be send to USCIS for H1B Transfer to be on the safer side. Do not complicate yourself and land on the desert danger zone.

So, play the rule of the game safely. You need to be very careful with Pros and Cons of both the side, Full time vs. Consultancy.

The benefits of full time is that you do not have to deal with the Indian Consultancy who takes chunk of your salary. Make sure that full time employee will file the GC for you immediately after you joined that (use GC chip as a deciding factor to join them). However, after joining them, after few weeks/months, if you are fired or lay-off , you are out-of-status immediately under H1B (so get TPS with EAD-my suggestion).

The benefits of Indian consultancy is there is never firing and lay-off, you just sit in the bench and enjoy the fruit. That's why they get the cuts out of your salary and they even might file GC for you if you convince them and they think that you are cash cow for them and get into project earning for them. WIN-WIN situation.
